TOPIC: LANDS OF HANZL SUBDIVISION AND IMPROVEMENT AGREEMENT
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING THE PARCEL MAP AND THE SUBDIVISION IMPROVEMENT
AGREEMENT FOR LANDS OF HANZL, 179 LOS RANCHITOS ROAD, SAN
RAFAEL, CALIFORNIA
RECOMMENDATION: Adopt Resolution.
BACKGROUND:
On October 9, 2007, the City Planning Commission approved the Vesting Tentative Map for the minor
subdivision of a parcel with an existing residential building located at 179 Los Ranchitos Road. The
property owner wished to subdivide the property into two parcels, one for each existing use and a vacant
lot to be developed with a new single family home. Access to the new property is by a panhandle
driveway, which has been widened through reciprocal private access easements. The proposed shared
driveway improvements include access to the new vacant lot for development of a single family home .
The Vesting Tentative Map has been extended through State and City extensions. The property owner has
now submitted a Parcel Map for approval so the map can be recorded with the County of Marin. This is
the last step in the process of subdividing the property into new lots. The proposed Subdivision
Improvement Agreement allows the subdivider to record the Parcel Map prior to completion of
improvements that are required by the Vesting Tentative Map approval but ensures that they will be
completed.
ANALYSIS:
The City Engineer, and the Acting City Surveyor, have reviewed the Parcel Map and found that it
conforms to the approved Tentative Map and related conditions of approval, and the provisions of SRMC
Title 15 (Subdivisions) and the State Subdivision Map Act. The accompanying Improvement Plans have
been reviewed and determined to be in compliance with City of San Rafael standards. Utility service is
currently provided at the existing building and additional utility service provided through the shared
driveway. The Parcel Map and subdivision improvement plans are available for review in the City Clerk’s
office.

Staff recommends, and has prepared the attached resolution for adoption requesting the City Council to:
1. Approve and authorize the City Manager to sign the Subdivision Improvement Agreement in a
form acceptable to the City Attorney;
2. Approve the Parcel Map for recordation; and
3. Direct the City Clerk to record the Parcel Map, following receipt of the fully-executed
Subdivision Improvement, and all required bonds, fees, insurance.
FISCAL IMPACT:
No fiscal impact to the City.
OPTIONS:
The Council has the following options to consider in this matter:
1. Adopt the resolution as presented, approving the parcel map, and approving the agreement;
2. Provide direction to staff for modification of the resolution;
3. Reject the resolution, which will prevent the property owner from recording the parcel map prior
to installation of the subdivision improvements.
ACTION REQUIRED:
Adopt the Resolution, Approving the Parcel Map and Approving the Subdivision Improvement
Agreement for Lands of Hanzl, 179 Los Ranchitos Road, San Rafael, California.

RESOLUTION NO. 14391
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING THE PARCEL MAP AND THE SUBDIVISION IMPROVEMENT
AGREEMENT FOR LANDS OF HANZL, 179 LOS RANCHITOS ROAD, SAN
RAFAEL, CALIFORNIA
WHEREAS, the Planning Commission of the City of San Rafael did on the 9th of
October, 2007 adopt Resolution Numbers 07-19 and 07-20 approving the Vesting
Tentative Map and Mitigated Negative Declaration to allow modification to the parcel,
and subdivide into two lots and for development of one new single family home,
currently located at 179 Los Ranchitos Road (APN: 175-292-34); and
WHEREAS, the applicant has submitted a Parcel Map for said subdivision,
entitled “PARCEL MAP LANDS OF HANZL” and supporting documents; and
WHEREAS, the Parcel Map dedicates a private Access & Utility Easement; and
WHEREAS, the City Engineer and Acting City Surveyor have examined the
Parcel Map and supporting documents and have determined that they comply with the
conditions of approval and requirements of the approved Tentative Parcel Map and the
requirements of the California Subdivision Map Act; and the City Engineer is
recommending that the City Council approve the Parcel Map; and
WHEREAS, the Community Development Department has examined the Parcel
Map and supporting documents and has determined that they comply with the
requirements of the approved Tentative Parcel Map; and
WHEREAS, a Subdivision Improvement Agreement has been proposed to
implement certain of the conditions of approval of the Tentative Parcel Map; and
WHEREAS, the City Engineer has examined the Subdivision Improvement
Agreement, and is recommending that this agreement be approved by the City Council.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Rafael approves the Parcel Map for the Lands of Hanzl.
BE IT FURTHER RESOLVED that the City Council of the City of San Rafael
approves accepting the Subdivision Improvement Agreement attached to the staff report
submitted to the City Council, subject to final approval by the City Attorney as to form,
and authorizes the City Manager to execute said Agreement.
BE IT FURTHER RESOLVED that the City Council of the City of San Rafael
hereby authorizes the City Clerk, upon receipt of the executed Subdivision Improvement
Agreement and all other required bonds, fees, insurance and other documents, to record
the Parcel Map and Subdivision Improvement Agreement in the Official Records of the
County of Marin.
