SUBJECT: A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING USE OF
STATE OF CALIFORNIA DEPARTMENT OF BOATING AND WATERWAY GRANT FUNDS
IN THE AMOUNT OF $35,000 FOR THE POLICE DEPARTMENT PATROL BOAT
EXTERNAL "KICK STEP" REPLACEMENT, CONVERSION TO COAST GUARD "RESCUE
21" RADIO FREQUENCY, RUBBER FENDER COMPONENT REPLACEMENT, AND
PURCHASE OF 3D UNDERWATER SONAR AND TWO PROPELLERS BY SEPTEMBER 30,
2012, AND AUTHORIZING THE MAYOR TO EXECUTE GRANT CONTRACT.
RECOMMENDATION: Staff recommends the Council adopt resolution authorizing execution of
contract with the Department of Boating and Waterways (DBW) to fund equipment purchase
and installation by September 30, 2012.
BACKGROUND: For more than thirty years, the San Rafael Police Department has patrolled
six square miles of navigable waters including five miles of federally maintained canal -ways
within the corporate limits of the City of San Rafael. This water area encompasses the San
Pablo Bay area north of McNears Beach/ San Pedro Point and south to the Red Rock Island
near the Richmond Long Wharf, including the deepwater channel for ocean-going ships.
The "Mission City" is one of the few law enforcement patrol boats currently operational on the
San Francisco Bay. Due to mechanical problems with both the City of Richmond and the Marin
County Sheriff's patrol boats, the "Mission City" is typically the sole law enforcement vessel
north of Angel Island. The other four law enforcement. patrol boats are staffed by the Cities of
San Francisco and Oakland and the Counties of San Mateo and Alameda. The Coast Guard,
due to Homeland Security restrictions, has reduced response to search and rescue activities in
the Bay, and calls upon the "Mission City" to respond to a greater number of rescues south and
east of the normal search and rescue area.
In 1985, the City of San Rafael received a grant for purchase of the current patrol vessel,
"Mission City". In 2006, the City of San Rafael received a grant for the replacement of the patrol
vessel engines. In 2007, the City of San Rafael received a grant for the purchase of a Thermal
Visioning System and an Automatic Identification System (AIS) GPS system.

Analysis: In February of this year, we applied to the Department of Boating and Waterways for
funding to repair the patrol boat external "Kick Step", convert the radio system to the Coast
Guard's new "Rescue 21" radio frequency, replace the rubber fender component on the outside
of the vessel, to purchase a 3D sonar system and to purchase two (2) propellers.
FISCAL IMPACT: The Grant will provide $35,000 to purchase the listed equipment. This
amount will cover the complete costs and not require the expenditure of any city funds.

Whereas, the City of San Rafael has operated the Police Department patrol
boat, "Mission City", continuously since 1985; and
Whereas, the State of California, Department of Boating and Waterways has
approved a grant in an amount up to $35,000 to the City of San Rafael for the
Police Department Patrol Boat "Kick Step" repair or replacement, conversion to
Coast Guard "Rescue 21" radio frequency, rubber fender component
replacement, and purchase of 3D underwater sonar and two propellers, and
NOW, THEREFORE BE IT RESOLVED, that Albert J. Boro, Mayor of the City of
San Rafael, is hereby authorized and directed to execute the Boating Safety and
Enforcement Grant Equipment and Operation Contract (#11-204-769), in the
form on file with the City Clerk, to fund the repair, replacement purchase and
installation of equipment for the Police Department patrol boat in an amount up to
$35,000 by September 30, 2012.

It is our pleasure to inform you that you have been awarded a grant in the amount of
$ 35,000.00 to purchase miscellaneous equipment (radio communications).
Enclosed is a complete copy of the Equipment and Operation Contract between the State
of California, Department of Boating and Waterways (Department) and the San Rafael Police
Department. In addition to the contract, several other documents have been enclosed for
signature. For your convenience, areas of concern have been tagged and highlighted. Please
read and comply with the following instructions. Failure to comply as stated herein will result
in your contract being disapproved.
1. Signature and Return:
Carefully review the Contract and verify your county information. Have all four copies
signed and returned to this Department. DO NOT TAKE THE CONTRACTS APART.
A fully executed copy of the contract will be sent to you upon completion.
2. Minute Order or Resolution:
We will also need one (1) certified copy of the Minute Order or Resolution of your Board of
Supervisors or City Council authorizing the execution of this Contract. The Minute Order or
Resolution must authorize by name and title the signatory of the Contract and must be
stamped with a certified county or city seal.

3. Contractor Certification Clauses and Recycling Certification:
Please have the attached Contractor Certification Clauses form CCC298 and Recycling
Certification form completed, signed, and returned to this Department along with the Contract
and Minute Order or Resolution. AGAIN, DO NOT TAKE THE CONTRACTS APART.
4. Procurement Standards:
This Contract involves State and/or Federal funds. Please follow the procurement instructions
contained in this Contract and exhibits. Please pay special attention to the specific
procurement standards regarding advertising by your department, adequate purchase
descriptions, sealed bids, and public openings. You will be asked to provide, with your written
request for reimbursement, a signed certification that you complied with approved
procurement procedures. Please refer to Articles III and XIII of the Contract.
Due to Federal procedural changes, you must now attain a fully executed contract,
complete your bid process, obtain a secured purchase order and submit for
reimbursement by September 30, 2012. NO EXCEPTIONS.
