SUBJECT: ACCEPT THE MID -YEAR CAPITAL IMPROVEMENT PROGRAM
2009/2010
RECOMMENDATION:
Accept staff report and direct Public Works Director to proceed with implementation of the
Capital Improvement Program (CIP) as listed below.
BACKGROUND:
At the City Council Study Session meeting of June 15, 2009, the Council reviewed the Capital
Improvement Projects for 2009/2010, and 2010/2011. The City Council, at the regular meeting
of July 6, 2009, adopted the following Capital Improvement Program as part of the city budget
for 2009/2010 fiscal year.
Following adoption of the CIP by the City Council, staff evaluated the methods and the
possibilities of reconstruction of Boyd Park Tennis Courts. It was determined that due to lack of
access for construction equipment to the courts, the cost of reconstruction may be as high as
$250,000, and it would have required closing Mission Avenue for the duration of construction.
However, that was not the only problem with implementation of this project. According to the
agreement with the Department of Justice, if the City considers any improvements to the courts,
the courts must comply with ADA requirements. Providing access to the courts in compliance
with ADA is cost prohibitive and almost impossible. The other tennis court in the City that must
be resurfaced to be useable is the court at Santa Margarita Park.
It was recommended to the Parks and Recreation Commission that Boyd Park tennis courts be
abandoned and the funds be used to resurface Santa Margarita court. The commission accepted
staff recommendation to use the funds for resurfacing the Santa Margarita courts and
recommended that the surface of the courts at Boyd Park be repaired to a safe condition so it can
be used for other activities.

accordance with the adopted CIP;
