SUBJECT: 122-150 Cresta Drive — Highlands of Marin and Crest Marin Apartments — Request to
rename the private street portion of Cresta Drive located on Highlands of Marin property to Cresta Way
and re -number nine buildings along the newly named portion of Cresta Way. The change would retain
use of the name "Cresta Drive' to the public street leading to the property; APN: 155-280-18; Multi -family
Residential (MR2.5) District; Marin NEWCO LLC, property owner; Gary Polodna, applicant; Case
Number: P09-012.
RECOMMENDATION:
Staff recommends that the City Council adopt the attached resolution (Attachment 2) approving the street
name change.
BACKGROUND:
History
On April 6, 2009, the City Council approved an Environmental and Design Review Permit (ED Permit) to
renovate the Highlands of Marin (HOM 1) and former Crest Marin (HOM II) apartment complexes, which
are located on a ridge north of Smith Ranch Road. The ED Permit allowed: a) the exterior renovation and
re -skinning of all of the apartment buildings, carports and recreation building; b) the replacement of an
existing tennis court with a new 2,785 sq. ft. leasing office building; and c) general site and landscape
improvements.
Project Description
On July 28, 2009, the property owner applied for approval to rename the private street portion of Cresta
Drive to Cresta Way and re -number nine buildings located on newly named portion of Cresta Way. The
change would retain use of the name "Cresta Drive" for the public street accessing the property
(Attachment 3). This attachment shows the public portion of Cresta Drive as blank and the private portion
as dark.
The major renovation of the HOM complex as approved by the City Council in April 2009 is currently
underway. The renovation includes new building exteriors with common architectural and color scheme
for both complexes that are now under one ownership. The proposal to rename the street would achieve
a cohesive address scheme with a clear and logical progression for the property which would reflect the
new status of the HOM complex as a consolidated property, and will simplify way -finding for visitors and
emergency respondents.
ANALYSIS:
Under SRMC Section 15.06.060 Street Names, the City Council has the authority to review requested
street name changes. As required by this Section, the project has been reviewed by Fire Department,
Police Department, Public Works Department, the U.S. Postal Service and other agencies including the

Community Development Director. None of these agencies have expressed any concern regarding the
requested street name change. If the City Council approves the requested street name change consistent
with SRMC Section 15.06.060, the Community Development Director would inform all City departments,
the U.S. Postal Service, affected agencies and utility services and local mapping services of the name
change. If approved, the street name change would be effective November 1, 2009.
The proposed street name change would affect 98 apartments in nine buildings. On September 4, 2009,
the applicant informed the affected tenants of the requested street name change. Additionally, the
applicant hosted a meeting on September 9, 2009 to answer any questions from the tenants. According
to the applicant, the meeting was attended by a few tenants who did not raise any concerns.
ENVIRONMENTAL REVIEW:
Pursuant to Section 15061 of the California Environmental Quality Act (CEQA), a project is not subject to
CEQA where it can be seen with certainty that there is no possibility that activity in question may have a
significant effect on the environment. Since the project is for a street name change, the proposed project
qualifies for a categorical exemption under Sections 15061 of CEQA.
NOTICE/CORRESPONDENCE:
City Council public hearing public notice for the October 5, 2009 hearing was mailed to the complex
tenants, neighboring property owners, businesses and residents within 300 feet of the property. A copy of
the public hearing notice and the notification list is provided as an attachment to the staff report
(Attachment 4).
Until the time of this Report writing (September 28, 2009) staff did not receive any public correspondence
regarding this project.
FISCAL IMPACT:
The project proposes a name change for an existing private street, which would not result in any fiscal
impacts to the City.
OPTIONS:
The following options may be considered by the City Council on this matter:
1. Approve the street name change as presented;
2. Approve the street name change with additional modifications,
approval;
3. Continue the application to allow the project sponsor to address
concerns of the Council; or
4. Deny the street name change.
ACTIONS REQUIRED:
It is recommended that the City Council:
1. Open the public hearing and accept public testimony;
2. Close the public hearing;

any new or additional comments or
3. Adopt a resolution approving the street name change (P09-012) (Attachment 2).

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING A REQUEST TO RENAME THE PRIVATE STREET PORTION OF
CRESTA DRIVE LOCATED ON HIGHLAND OF MARIN PROPERTY TO
CRESTA WAY AND RE -NUMBER NINE BUILDINGS ALONG NEW PORTION
OF CRESTA WAY (APN: 155-280-18)
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
WHEREAS, on April 6, 2009, the City Council approved an Environmental and
Design Review (ED) Permit (ED08-011) to renovate the Highlands of Marin (HOM I) and
former Crest Marin (HOM II) apartment complexes, which are located on a ridge north of
Smith Ranch Road; and
WHEREAS, the ED Permit allowed exterior renovation and re -skinning of all of
the apartment buildings, carports and recreation building; the replacement of an existing

WHEREAS, consistent with SRMC 15.06.060, the Fire Department, Police
Department, Public Works Department, the U.S. Postal Service and other agencies
including the Community Development Director reviewed the proposed street name
change project and recommended approval; and
WHEREAS, on September 4, 2009, the project applicant informed tenants of the
98 affected apartments of the requested street name change and hosted an informational
meeting of the tenants on September 9, 2009; and
WHEREAS, no concern has been expressed regarding the requested street name
change; and

WHEREAS, the requested street name change is not anticipated to cause a change
in City service costs nor is it expected to generate any more demand in City services or
emergency responses as well as street and drainage maintenance and other municipal
services to these properties; and
WHEREAS, the Community Development Director shall inform all City
departments, the U.S. Postal Service, affected agencies and utility services and local
mapping services of the approved street name change; and
WHEREAS, upon review of the application, the City Council has confirmed that
pursuant to Section 15061 of the California Environmental Quality Act (CEQA)
Guidelines, the proposed project is categorically exempt from the requirements of CEQA.
Section 15061 exempts projects where it can be seen with certainty that there is no
possibility that activity in question may have a significant effect on the environment. Since
the project is for a street name change, the proposed project qualifies for a categorical
exemption under Sections 15061 of CEQA; and
WHEREAS, the custodian of documents which constitute the record of
proceedings upon which this decision is based, is the Community Development
Department; and
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San
Rafael hereby approves the requested street narne change (P09-012) based on the following
findings:
FINDINGS
1. The requested street name change has been processed consistent with SRMC
15.06.060, in that the Fire Department, Police Department, Public Works Department,
the U.S. Postal Service and the Community Development Director reviewed the project
and recommended its approval. Further, the Community Development Director shall
inform all City departments, the U.S. Postal Service, affected agencies and utility
services and local mapping services of the name change.
2. Tenants of the 98 affected apartments were informed of the requested street name
change and did not express any concern; and
3. The approved street name change is not anticipated to cause a change in City service
costs, nor is it expected to generate any more demand in City services or emergency
responses as well as street and drainage maintenance and other municipal services to
these properties.
4. Pursuant to Section 15061 of the California Environmental Quality Act (CEQA), the
proposed project is categorically exempt from the requirements of CEQA. Section

Proposed Street Name and Address Changes
Highlands of Marin is a 324 -apartment multifamily property located off Cresta Drive in San Rafael.
The property was developed in two phases: buildings 1 through 7 Cresta Circle and buildings 125
and 130 through 150 Cresta Drive (formerly known as Crest Marin) were built in the late 1960's;
1010 through 1070 Cresta Way and buildings 122 through 128 Cresta Drive were built in 1989 and
1990 (please refer to the attached Existing Address Plan). Ownership of the two phases was
consolidated under Northbay Properties Il, LP (an affiliate of UDR, Inc.) in October 2007 and the
property is now operated as a single rental community.
A major renovation of the property was started earlier this year which includes new building
exteriors with common architectural and color schemes. We are proposing to create a cohesive
address scheme with a clear and logical progression for the property which will not only reflect its
new status as a consolidated property but, more importantly, will simplify way -finding for visitors
and emergency responders.
We propose to rename the existing portion of Cresta Drive located on Highlands of Marin property
to "Cresta Way" and re -number nine buildings along the new portion of Cresta Way as shown on the
attached Proposed Address Plan and as listed in the table below. This change will effectively limit
the use of the name "Cresta Drive' to the public street leading to the property, and provide
consistent Cresta Way and Cresta Circle addresses for the apartments on the property.
