SUBJECT: Proposal for Canal Community Garden project on City property located at Bellam Blvd. and
Windward Way.
RECOMMENDATION: Approve in Concept the Canal Community Garden project.
BACKGROUND: When the Pickleweed Community Center was renovated and expanded in 2004-
2006, the former Canal Community Garden operated by Canal Alliance was displaced. In 2007, the
Canal Community Gardens and Trails Collaborative, a group of local non-profit agencies, began meeting
to re-establish a community garden in the Canal Neighborhood. Several sites were considered. Most
were publically held land: the County of Marin Health and Wellness Campus, Pickleweed Park, Schoen
Park and the City owned property at the corner of Bellam Blvd. and Windward Way. Due to site
constraints on most of the locations, the vacant property on Bellam Blvd and Windward Way was
determined to be the most feasible for a Community Garden installation.
The Trust for Public Land received grant funding from the Marin Community Foundation to conduct a
community process that resulted in a design concept and plan for a new Canal Community Garden. In
May and September of this year, the Park and Recreation Commission reviewed the original proposal for
the concept and plan, requested additional information and approved the proposal for recommendation to
the City Council.
ANALYSIS: The desire for a community garden in the Canal Neighborhood has been establish though
the public outreach process conducted by the Canal Community Gardens and Trails Collaborative, and
the Trust for Public Land. The City of San Rafael owns the only public land available for this use in the
Neighborhood. The City does not have capacity to design, build, maintain or manage a community
garden facility. Therefore the concept of a non-profit corporation leasing City property to install and
operate a desired public community garden is a sound one. The Canal Alliance, a long-standing non-
profit corporation providing services to the Canal neighborhood, has expressed its willingness to manage
the community garden.
Lease/Agreement for use of the City's property
If the City Council approves in concept the Proposal for the Canal Community Garden, City staff will enter
into negotiations with the Canal Alliance for a lease/agreement with the Canal Alliance for use of the
City's property for the community garden project, which will be brought back to the City Council for its
approval. The existing Agreement between the City and the Marin Bocce Federation for use of a portion
of Albert Park is an example of an agreement for use of City owned property, developed and managed by

a non-profit organization for public recreation. That Agreement would be used as a model for a
Lease/Agreement with the Canal Community Alliance for a community garden.
Collaboration
Assuming the City Council initially approves in concept the Proposal and then approves a
Lease/Agreement with the Canal Alliance, the Trust for Public Land will complete the fundraising process,
construction documents, permit process, and construction management. The Canal Alliance is expected
to coordinate the following partnership groups listed in the Proposal in the operation the Canal
Community Garden:

Site and Improvements. The site was deeded to the City by the San Rafael Sanitary District in 1984. It is
currently vacant and is not planned for development or other use in the near future. There is a sewer
easement over the property. Traffic and parking are adequate to support a community garden facility.
Neighborhood and Police Department issues have been incorporated in the design process to assure that
the facility is compatible with the surrounding residents and businesses. Paramount to the acceptance of
a community garden on this site is sustainable landscape and secured fencing along the outside
perimeter of the facility.
The Proposal calls for a facility with the following amenities:
102 garden beds, greenhouse, shed, potting area with sink, covered outdoor classroom, trash and
compost facilities, rainwater catchment, educational signage, pathways, cultural planting areas, perimeter
fencing, perimeter landscaping, bike parking, two entries, water and electricity connections.
Timeline
The Proposal calls for construction to begin in July 2011. In addition to finalizing a Lease/Agreement with
the City, the community Garden project will be subject to the City Use Permit process and the Building
Permit process. The timeline will be affected by these processes and by financing.
Operational Issues
Use -The use of this public property will be for the recreational benefit of the residents of San Rafael.
Participation in the Garden, or programs conducted there will be available to the public The Canal
Community Garden will be open to residents of the City of San Rafael for an annual participation fee per
garden plot. Plots are of varied sizes to suit different ages, abilities, and time commitment. Rules and
Regulations for participants will be determined by the participating gardeners with the direction of the
managing partner, Canal Alliance. The facility will be utilized for community education and demonstration
programs, also coordinated by Canal Alliance. The Lease/Agreement between the City and Canal
Alliance will stipulate goals for the program, deliverables, financial reporting, etc.
The construction costs are estimated to be $487,000 and annual operating budget is projected at
$51,340. Initial plan funding has been received by Trust for Public Land. Construction and operation
funding has not been wholly secured.
Management — Canal Alliance is proposed as the lessee of the City's property and the management
partner for the Canal Community Garden. Canal Alliance is expected to commit a half time employee
who has recent experience organizing organic gardens within housing facilities in the Canal
Neighborhood. Canal Alliance will also provide a professional gardener to organize and conduct
volunteer efforts to maintain the facility. The group will coordinate the other collaborative partners. For
example conservation Corps North Bay has agreed to larger scale maintenance such as irrigation repair,

drainage maintenance, gate and fencing repair. Funding to support the management will be the
responsibility of Canal Alliance.
Park and Recreation Commission Recommendation
The Park and Recreation Commission has recommended City Council approval of the Canal Community
Garden Proposal. Minutes of the September 16 meeting are attached as Exhibit B. The Commission
was clear that their approval was for the concept as presented in the Proposal. Changes in the plan,
elements, collaborative partners, should be approved by the Commission and/or City Council.
FISCAL IMPACT: All associated costs for the Canal Community Garden will be assumed by the
Proposal partners. No City funding or staffing resources are available for this project. City staff resources
will be necessary to negotiate the Lease/Agreement with the Canal Alliance and to monitor it going
forward.
OPTIONS:
1. Approve in concept the Proposal for the Canal Community Garden, subject to the City Council's
approval of a Lease/Agreement to be negotiated by City Staff with the Canal Alliance for use of the City's
property at Bellam Blvd. and Windward Way for that purpose.
2. Direct staff to bring additional information to the City Council needed by it to make a decision on
approval of the Proposal in concept for the Canal Community Garden.
3. Reject the Proposal for the Canal Community Garden.
ACTION REQUIRED: Approve in concept the Proposal for the Canal Community Garden, subject to the
City Council's approval of a Lease/Agreement to be negotiated by City Staff with the Canal Alliance for
use of the City's property at Bellam Blvd. and Windward Way for that purpose.

DESCRIPTION:
Residents of the Canal community come from a variety of ethnic
backgrounds, many with a strong tie to food culture. Vietnamese and
Hispanic families in the Canal neighborhood have expressed keen interest
in being able to grow and produce foods important to their heritage in a
community garden setting. By providing the neighborhood access to
gardening opportunities, the community garden will foster leadership and
encourage connections within a very diverse community. The Trust for
Public Land (TPL) will also help the City and local community
organizations to develop a sustainable management model for the garden.
SITE FEATURES:
The proposed site is an empty lot, owned by the City of San Rafael, with easy
access to the Canal community. Located on the corner of Bellam Blvd and
Windward Way, it is across from a walking and bike path and close to the
freeway. It has no existing vegetation that would block direct sun and its
proximity to the ocean ensures cooling breezes. There is water access
through a street tie in, to be installed as part of the project construction. Per
the proposed design, the garden has the capacity to feed 102 gardeners/
families.
COMMUNITY-BASED
A large number of organizations are interested in helping to make this

Gardeners, Conservation Corps North Bay, Marin Link, Marin Organics,
Canal Community Gardens and Trails Collaborative, Healthy Marin
Partnership and TPL.
DEMOGRAPHICS:
A significant portion of Marin county's low-income housing in located in
the Canal neighborhood. According to the 2000 Census, 640la of Canal
residents are foreign -born. In a county whose population is 85% Caucasian,
the Canal neighborhood is one of the most diverse: 67% of neighborhood
residents are Latino; 20% are Caucasian; 8% are Asian; and 3% are African-
American. In the last ten years alone, a large number of immigrants have
relocated to the neighborhood, resulting in a 70% increase in the Canal
area's population.
OPPORTUNITY: Canal neighborhood residents and local advocacy groups are already
pushing to make organic produce more available, to provide classes and
education on growing organic foods, and to help increase community
health opportunities. The community garden will provide space for
partners to work with the community on these goals, all within walking
distance of their homes. Starting with an empty piece of land allows the
community to craft what they want out of a community garden and to feel
like true participants in its birth and development.
ISSUES & The City of San Rafael will approve the project only if they have an agreement
CHALLENGES: with an installation partner and a long-term management partner. TPL is
interested in acting as the installation partner and Canal Alliance is willing to be
the management and maintenance partner. The City needs clear delineation of
responsibilities between these organizations to feel comfortable to proceed.
STATUS: Supervisor Kinsey's office has fundraised significant donations and in kind
services for the project. A $30K allocation from the county will expire this
coming fiscal year if the project does not begin construction.
TPL received two $25K grants from the Marin Community Foundation for
community outreach and design. TPL has also received a $10K grant from
First 5 Marin for outreach and construction.
Conservation Corps North Bay received a $25K grant from the Marin
Community Foundation, part of which includes community outreach for
the Canal community garden, to be finalized mid 2010.
A preliminary estimate for the project demonstrates that more funds will
need to be raised for project completion. Supervisor Kinsey's office, Canal
Alliance and TPL are committed to raising the additional funds needed.

The Canal Community Garden project is a proposed collaboration between The Trust for Public
MEAN Land, Canal Alliance, the City of San Rafael and the Canal community. This proposal advocates for
the construction of a community garden on an empty, city owned parcel at the corner of Bellarn Blvd

The Trust for Public Land (TPL) is a national non-profit organization that builds parks, gardens and
www.tPLorg open space for communities in need. TPL has over 30 years of project experience and its dedicated
and talented staff that are well versed in community outreach and project construction.
Recent outreach efforts to members of the Marin community have been successful in raising
awareness and funds towards the completion of the project. TPL feels confident that it can generate
enough support to finish the project in a timely manner and deliver a quality project to the City of
San Rafael.
TPL will act as lead agency for community outreach, project development, design and installation of
the community garden. Upon construction completion, the project will be given as a gift in place to
the City. This role entails:

Garden Management
Canal Alliance
Canal Alliance will act as lead agency for management and maintenance of the community garden.
The Trust for Public Land will help to facilitate a binding contract between the City of San Rafael
and Canal Alliance before construction is complete for this management and maintenance role.
Canal Alliance will commit a half-time employee to the management of the garden to cover the
administrative and gardening responsibilities. Canal Alliance's management has chosen Maite Durin
to take on the leadership of the garden. Her work as a community organizer in the Canal
neighborhood has prepared her well to oversee the garden. Her name is well known in the
community and she is respected among community members and agencies.
Maite has been heading a community organizing effort for over two years, which includes the
creation of organic community gardens within buildings in the Canal neighborhood. She identified
leaders in the buildings, gained the trust of the residents, and assembled the myriad resources
required to install raised beds, soil, and the appropriate plants. She employed the help of Marin
Master Gardeners, Marin Organics, and other local bodies of knowledge to assist her program. This
project was spearheaded with the support of two generous community organizing and health related
grants funded by the Stuart Foundation and the Tides Foundation. Canal Alliance is actively seeking
grant funding to continue this effort, and to include their work in the Canal Community Garden.
In addition to Maite's role, a professional gardener/permaculture specialist will work 10 hours per
week with interested youth and young adults from all the communities in the Canal to create a
"garden group". These gardeners will be trained and guided by the professional gardener/
permaculturist, to perform all the necessary tasks to maintain and upkeep the garden, as well as to
educate other gardeners. An Advisory board of gardeners /professionals will also be created to help
guide the vision for the Canal Community Garden.

As manager of the garden, Maite and Canal Alliance will oversee A of the administrative tasks
associated with the garden. Those include:

include individual plots, common areas and trash/composting areas
b. Purchase general use gardening tools, hoses and keys
c. Oversee repair of non-structural items, ie: gates, fences, compost bins, tool sheds,
benches, etc
d. Hire professionals for repair of structural items in coordination with the City of San
Rafael, ie: tool sheds, shade trellis, or any item under which a person may occupy,
and major infrastructure repair, ie: water line or electrical work
e. Coordinate yearly garden maintenance donation from Conservation Corps North

Garden Users
Canal Community Gardeners
The Canal Community Gardeners will be the end users of the project. Among these gardeners shall
be elected a Garden Committee that will assist the managing partner of the community garden. This
role entails:

a. Provide feedback during community meetings/events on project design,
management & maintenance

Mack5 has prepared the following Conceptual Design Cost Plan for the Canal Community Garden.
The estimate was prepared using Conceptual Design drawings and program documents. The
estimate includes four sections; a commentary on the basis of the estimate, an overall summary of
the entire project, individual detail sections, and a section for alternates.
The total construction cost included in this estimate is $487K. These costs are qualified in the
commentary section with inclusions and exclusions and supported by detailed cost breakdowns in
each detail section. These do not include soft costs or project costs.

The site is relatively flat and will require minimal grading in

site improvement Paving is limited to concrete pedestrian paving along two
main entrance paths, at the center of the garden, and at the
accessible raised planter areas. All of other pedestrian
paving is decomposed granite.
Site structures include a wooden trellis at an outdoor
classroom area and allowances for a prefabricated green
house and a storage shed.
Site development includes raised planter beds, a potting
table with sink and drinking fountain, compost and trash
bins, prefabricated wooden benches, site signage, bike
racks at both entrances and perimeter fencing and gates.
Landscaping consists of soil imports for the planting beds
as well as soil treatment, planting, and mulch for the native
perimeter planting and cultural planting areas.
site mechanical utilities Domestic water includes a new line from the street into the
site, a water meter, backflow preventer, hose bibbs, and an
allowance for irrigation of the native perimeter planting and
cultural planting areas.
A sewer tie in and line is included from the sink at the
potting table to the street.
An allowance is included for a series of cisterns and
associated plumbing to capture rain water for reuse in the
garden.

The Carpenter's Union has offered in kind labor donation for the construction of raised planters,
trellis and potting area, worth $13,000.
Marin Organic
Marin Organic has offered in kind seed donation, worth $1,000.
Marin Sanitary Service
Marin Sanitary Service has offered in kind soil, mulch and dumpster donation, worth $18,000, and
financial support of $3000. The extent of this gift is still being determined.
Ghilotti Construction
Ghilotti Construction has offered in kind labor and materials donation for the grading and site

A. Review of Proposal for Canal Community Garden
Director yNcC8rt introduced the item with 8 review of the May meeting where Trust for
Public Land first proposed the Canal Community Garden project 0Oth8COO1DliSSiOn.
The concept was approved, but TPL was requested to return with more in depth
information about the management plan and partner for the garden, and commitments
from the collaborative partners 10the project. K8CC8rtreintroduced M8Qh3nPecaut.The
Trust for Public Land topresent additional information.
Ms Pecaut reiterated the Canal Community Garden proposal was in response to a
community outreach process. Thedesign relates tOthe elements desired by the
residents and organizations iDthe Canal Neighborhood. 'lPLwas granted funding tO
C0OdU[t the community outreach pn]0eSS' C[g8&a the design, |88d the fundraising
C8Dlp8igD, develop the design through CODSt[UCdOO dOCuOOoDts' file for all permits, bid
the project 8OdpnOvidRCOOStruCtiODrD3D8gemOen1. Since May, the project h8S8ttrmct8d
funding and service commitments and 8new management organization.
Two community meetings were held with 40participants iOattendance. The attendees
support the concept for 102garden plots, outdoor classroom, and other site features
included inthe concept p|8n..
Further conversation with Marin Master Gardeners and Marin Conservation Corps
refined the concept of public education opportunities at the proposed Garden.
Construction budgets were updated. The project iSDOVveStiDl8tedtOcoSt$487,000tD
construct and $51,OOOkJmanage annually. Financial partners are under solicitation Et
present. Matching donors are particularly sought.

originally agreeable to managing the Canal Community Garden after construction. The
group no longer has the fiscal capacity to do so. Canal Alliance, a San Rafael non profit
operating in the Canal neighborhood met with TPL, project partners and City staff about
the management role and has stepped forward to assume it as lead agency. Ms Pecaut
Park and Recreation Commission introduced Sandy Poneck, Supervisor of Development
for Canal Alliance to elaborate on the organization's suitability for the management role.
Ms Poneck reported that Canal Alliance received a three year grant to fund a current
program assisting apartment communities in the Canal Neighborhood organize organic
garden projects. Four sites are operating communal gardens and more are requesting
the services of the project organizers. Maite Duran is the current staff person assigned
to the organic gardens project and prepared to assume the staff role for the
management of the Canal Community Garden. She is well known in the community and
well connected to the gardening industry and organizations in Marin County. Her position
will be .5 FTE in this roll. In addition to Ms Duran's administrative position, Canal
Alliance anticipates hiring a professional gardener/permaculture specialist 10 hours per
week to work with interested youth and young adults in the Canal Community Garden.
An Advisory Group of participants in the Garden will be formed to assist in the creation
and enforcement of rules and regulations, program development and other issues.
Commissioners inquired about funding for the positions. Poneck responded Canal
Alliance is seeking grant funds for the two staff positions and the operating costs.
Mr. David Escobar, representing Marin County Supervisor Steve Kinsey, stated the
community garden is part of a larger vision for the Canal Neighborhood supplementing
the County Health Care Center, the Pickleweed Community Center, Marin Square, and
other community serving enhancements. The garden project has green value systems
and organic gardening opportunities that will benefit the community with focus on health
and wellness.
Ms Teri Rockas, Kaiser Healthy Marin Partnership spoke for the project. She added the
garden project will be one more tool to combat obesity issues and provide insight to
healthier choices for children and families. She stated date support links to general
population health and diverse demographic opportunities.
Commissioner Clark inquired if Kaiser has shown support for the project. Ms Rockas
replied that the group has applied for a Kaiser Foundation Grant, and the results will be
known in January 2011. Marin Community Foundation has encouraged the project
partners to apply for grant funding as well. Commissioner Jones inquired about other
funding commitments. Ms Poneck replied as Development Department Director of
Canal Alliance, she will consider this core project and work toward full funding.
Clark went on to ask how the garden plots will be assigned. Ms Pecaut replied the
Advisory Committee will design the assignment system.

Commissioner Quintero asked if the participants will pay for the use of the garden and
programs. Participants will be charged a small fee to pay for maintenance of the
Community Garden. Are construction costs covered by fundraising yet? No.
Chair Mihan stated that there are many operational details not included in the proposal.
He asked that Canal Alliance and TPL return at an appropriate time with an operational
plan for the Commission to review. Mr. Escobar replied that interns serving the County
researched and prepared reports on four management models operating across the
country. From these a model will be selected or created to guide the operations of the
Canal Community Garden. Pecaut said that the second half of the community process
will focus on operational issues.
Mihan continued with a question regarding eligibility for participation in the garden. The
Garden will be open to all residents; however there may be a percentage of plots allotted
to different demographics to insure diversity. His question regarding security was
answered with the assurance that fencing, gates and keys will be utilized and the San
Rafael Police have submitted suggestions as well. Fencing and structures will have low
profile features to preserve sight lines. The designers are considering switching a
restroom facility for the water capture tank to improve the sight lines and service to
participants.
McCart inserted that Rodger Roberts and Jean Starkweather representing Marin
Conservation League both contacted staff and are in support of the project.
It was M/s Clark/Holm to approve the proposal for the Canal Community Garden,
recommending it to City Council with the provision that amendments to the current plan
must be submitted for Commission review.

B. Recognition of the Marin Master Gardeners
Chair Mihan described his visits to the Mediterranean and Succulent Gardens at the
Falkirk Cultural Center. Marin Master Gardeners and City of San Rafael have a five year
agreement for the organization to design, install and maintain the two gardens on the
grounds of the Cultural Center. Both areas are planted as demonstration gardens,
highlighting native and exotic plantings that are suited well to the Marin environment.
The gardens are also examples of low water consuming landscape. Now maturing the
gardens are attracting tours of local and out of area residents. Sales of plants and
seedlings have helped financially support the projects.
Marin Master Gardeners have dedicated countless hours to the success of the two
gardens and continue to provide maintenance through volunteers. Master Gardeners
