BACKGROUND: The Americans with Disabilities Act (ADA) requires accessibility improvement for all public works projects. The City of San Rafael, in general, has three types of accessibility projects: 1. A Settlement with the Federal Department of Justice (DOJ) to provide accessibility to City owned property including buildings parks and facilities and installation of 800 curb ramps on the streets where improvements were implemented prior to 2004. The DOJ settlement is between August 2004 and February 2014. 2. Annual curb ramp installation and path of travel improvements such as new sidewalks, pathways 3. Curb ramp installation for public works improvements projects The 2010 ADA Standards for Accessible Design, released by the Department of Justice (DOJ) in September 2010, indicates that "altered streets, roads, and highways must contain curb ramps or other sloped areas at arty intersection having curbs or other barriers to entry from a street level pedestrian walkway." The report further defines altered as "a change to a building or facility that affects or could affect the usability of the building or facility or portion thereof. Alterations include, but are not limited to, remodeling, renovation, rehabilitation, reconstruction, historic restoration, resurfacing of circulation paths or vehicular ways..." Therefore installation of any missing curb ramps is required in order to resurface a roadway. In anticipation of the upcoming Citywide Street Resurfacing 2012 Project, the city designed 15 missing curb ramps along the following roadway segments which are proposed for resurfacing later this year: • Fifth Avenue from B Street to H Street; • Redwood Highway from Smith Ranch Road to Mitchell Boulevard; • Bellam Boulevard from Woodland Avenue (City Limits) to 1-580 Ramps; • Bellam Boulevard from Kerner Boulevard to Windward Way; • D Street from Antonette Avenue to Second Street; and • Mission Avenue from Union Street to H Street. File No.: 6 - t - Council Meeting: Disposition: (I a SAN RAFAEL CITY COUNCIL AGENDA REPORT I Page: On July 2, 2012 the City Council adopted Resolution No. 13369 authorizing the Public Works Director to enter into an agreement with Fieldstone Construction Company to install 15 curb ramps at the following locations: ■ Mission Avenye & Maly Street (I Ramp) ■ Mission Avenue & Nye Street (I Ramp) ■ Mission Avenue & Wilkins Street (3 Ramps) ■ Mission Avenue & Cottage Avenue (I Ramp) Mision Avenue & Forbes Avenue (I Ramp) ■ D Street & Antonette Avenue (I Ramp) ■ D Street & Taylor Street (3 Ramps) ■ D Street & First Street (I Ramp) ■ Bellam Boulevard & Vista Del Mar (3 Ramps) 14 of the above curb ramps have been installed or are scheduled to be installed within the next 2 weeks. In response to members of the community's request to discuss the crosswalk removal instead of the Sycamore tree removal which is required to install the 15'h curb ramp at the intersection of D Street and Taylor Street, the ramp has been removed from the project and is currently not scheduled for installation and will be discussed with a staff presentation.
