TOPIC: Retaining the property located at 519 Fourth Street for City government use.
SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
CONFIRMING USE OF THE PROPERTY LOCATED AT 519 FOURTH STREET AS
GOVERNMENTAL USE PROPERTY
RECOMMENDATION: Staff recommends that the City Council approve the resolution.
BACKGROUND: The former San Rafael Redevelopment Agency acquired a variety of properties
located within the Redevelopment Project Area. The majority of these properties were acquired for
long term governmental use including parking lots, pump stations, the Redevelopment Agency offices
and the former County garage located at 519 Fourth Street. In addition the Agency assisted the City in
acquiring private parcels as part of road projects especially in the West Francisco -Andersen Drive area.
All Redevelopment Agencies in the State were dissolved in 2012 pursuant to the Assembly Bill 26
("Dissolution Act"). The Dissolution Act required redevelopment successor agencies to prepare a long-
range property management plan to provide for the disposition and use of the former redevelopment
agency properties. The Dissolution Act provided that all properties held by the former redevelopment
agencies must be either transferred to the city as governmental use properties or sold and the funds
from the sale distributed to the taxing entities within the former Redevelopment Project Area.
ANALYSIS: The San Rafael Long Range Property Management Plan included twenty-two properties
(Attachment A). San Rafael's Long Range Property Management Plan ("LRPMP") stated that all
parcels should be transferred to the City for governmental use with the exception of one property
located at Rice Drive/West Francisco and one property located on Andersen Drive.
The Oversight Board approved the LRPMP on May 18, 2015. The LRPMP was submitted to the
California Department of Finance on May 21, 2015. The California Department of Finance requested
additional information on the governmental use at 519 Fourth Street.

519 Fourth is the former County garage. The garage was acquired by the Agency and has been the
subject of a long range clean up, mitigation and monitoring plan due to contamination from its former
use. The building is currently used by various City Departments, including Economic Development,
Public Works, Community Development and Police, for storage, equipment and staging for operations.
The facility is heavily used due to its convenient location close to City Hall and Downtown. Chief
Bishop provided a letter to the California Department of Finance outlining the Police Department's use
of the facility (Attachment B). The Department of Finance requested a resolution from the City Council
on the use of the property in addition to the information provided by the Economic Development and
Police staff.
FISCAL IMPACT: If the State approves the transfer of the property, there is no impact to the General
Fund. If the State does not approve the property transfer, the City will have to sell the property and find
another location to replace the current uses. The proceeds from the sale are required to be transmitted
to the County Auditor -Controller for distribution to the taxing agencies located in the former
redevelopment project area. The distribution would be based on the property tax allocations; the two
largest taxing entities are the K-14 schools and the County. The City's share is about 13%. Without
paying for an appraisal, staff does not have an estimate of the potential sales price. However, the sale
price will be negatively impacted by the State required ongoing environmental monitoring. The potential
City share of the sale proceeds is about 15% of the total sales price less sales costs. .
OPTIONS:
• Adopt the resolution retaining the property located at 519 Fourth Street for governmental use.
• Reject the resolution. Staff does not recommend this option.
RECOMMENDED ACTION:
Adopt the resolution.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL CONFIRMING USE OF THE PROPERTY
LOCATED AT 519 FOURTH STREET AS
GOVERNMENTAL USE PROPERTY
WHEREAS, the California state legislature enacted Assembly Bill x 126 (the
"Dissolution Act") to dissolve redevelopment agencies formed under the Community
Redevelopment Law (Health and Safety Code Section 33000 et "se and
WHEREAS, on January 3, 2012, the City Council (the "City Council") of the City of San
Rafael (the "City") adopted Resolution No. 13279 declaring that the City would act as successor
agency (the "Successor Agency") for the dissolved San Rafael Redevelopment Agency (the
"Former Redevelopment Agency") effective February 1, 2012; and
WHEREAS, on February 1, 2012, the Former Redevelopment Agency was dissolved
pursuant to Health and Safety Code Section 34172; and
WHEREAS, the Dissolution Act provides for the appointment of an oversight board (the
"Oversight Board") with specific duties to approve certain Successor Agency actions pursuant to
Health and Safety Code Section 34180 and to direct the Successor Agency in certain other
actions pursuant to Health and Safety Code Section 34181; and
WHEREAS, pursuant to Assembly Bill 1484, enacted June 27, 2012 to amend various
provisions of the Dissolution Act, the Successor Agency is now declared to be a separate legal
entity from the City; and
WHEREAS, by letter dated November 24, 2014, the Successor Agency received a
finding of completion from the Department of Finance (the "DOF") pursuant to Health and
Safety Code Section 34179.7; and
WHEREAS, pursuant to Health and Safety Code Section 34191.5(b), the Successor
Agency must submit to the Oversight Board and the DOF, no later than six months following the
issuance by the DOF to the Successor Agency of the finding of completion, a long-range
property management plan that provides for the disposition and use of the real property assets of
the Former Redevelopment Agency (the "Long -Range Property Management Plan"); and
WHEREAS, on May 18, 2015 the Successor Agency submitted its Long -Range Property
Management Plan to the Oversight Board; and
WHEREAS, pursuant to Health and Safety Code Section 34191.5, the Oversight Board
adopted Resolution No. 2015-5 on May 18, 2015, approving the Successor Agency's Long -
Range Property Management Plan; and
WHEREAS, pursuant to Health and Safety Code Section 34181(a) and (f), the Oversight
Board also adopted Resolution No. 2015-6 on May 18, 2015, after due notice, approving the
transfer to the City of governmental use properties as identified in the Long -Range Property
Management Plan; and
WHEREAS, pursuant to Health and Safety Code Section 34191.5, the Successor Agency
submitted the Oversight Board -approved Long -Range Property Management Plan to the DOF on
May 21, 2015; and
WHEREAS, the DOF has reviewed the Long -Range Property Management Plan and has
requested that the Successor Agency provide a City Council resolution confirming the use of the
property located at 519 Fourth Street in the City of San Rafael (APN: 014-123-06) as a
governmental use property, prior to DOF approval of the Long -Range Property Management
Plan; and
WHEREAS, by staff report accompanying this Resolution and incorporated into this
Resolution by this reference, the City Council has been provided with additional information
upon which the findings and actions set forth in this Resolution are based.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael,
based upon all information submitted to or considered by the City Council during its
deliberations on this matter, as follows:
Section 1. Recitals Correct. The foregoing recitals are true and correct.
Section 2 Confirmation of Governmental Use of 519 Fourth Street Property. The
property located at 519 Fourth Street in the City of San Rafael (APN: 014-123-06) is currently
used as a secondary corporation yard for the City, and, specifically, is used by the City's Police
Department primarily as an evidence locker and for storage of Police Department vehicles. The
City Council hereby confirms that it intends to continue to use and operate the 519 Fourth Street
property as it is currently used, namely, as a secondary corporation yard and as a governmental
use property as set forth in the Long -Range Property Management Plan.
Section 3. Further Actions and Documents. The City Manager or designee, following
consultation with the City Attorney, is authorized to take all actions and execute all documents
on behalf of the City necessary to effectuate the purposes of this Resolution.
Section 4. Effectiveness of Resolution. This Resolution shall be in full force and
effect on the date of its adoption.
