LEONCI 1�, City Clerk ORDINANCE NO. 1451 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM "U" (UNCLAS- SIFIED) TO P -D (PLANNED DEVELOPMENT) DISTRICT (Civic Center Plaza) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Muni- cipal Code is amended by reclassifying the following real property from "U" (Unclassified) District to P -D (Planned Development) District. Said property so reclassified is located on Civic Center Drive, San Rafael, County Assessor's Parcels 180-121-34 and 35 described in Exhibit "A". DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "B" which is attached hereto and made a part hereof. DIVISION 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. L ONCI, City Clerk - 2 - / EXHIBIT "A" DESCRIPTION All that certain Real Property situate in the City of San Rafael, County of Marin, State of California, described as follows: PARCEL ONE: BEGINNING at Station 73 of the Inner Line of Salt Marsh, as shown upon that certain map entitled, "Map No. 3, of Salt Marsh & Tide Lands, situate in the County of Marin, State of California, 1871", a copy of which map was filed July 20, 1959 in "Can F" Marin County Records; running thence along said Inner Line of Salt Marsh, South 77° 13' 00" I -lest 752.670 feet to the most Northerly corner of that certain parcel of land described as Parcel One in the Lis Pendens entitled, "County of Marin vs. H. W. Laster, et a1," filed for record September 2, 1965 in Book 1976 of Official Records, at Page 469, Marin County Records: running thence along the Northeasterly line of said Parcel. EXHIBIT "B" Conditions which were included as part of the zoning (Z82-4) action by the Planning Commission on November 23, 1982: Master Plan Conditions (Z82-4): (a) The site is approved for 87,500 square feet gross of profes- sional office space in two buildings of equal size and for 47 townhouse condominium units with the general site design as depicted on the plan by Andrew James Ring III, dated March 11, 1982. Said uses are contingent upon the conditions specified in UP82-22. The office size can be increased to 96,000 square feet at the time of design review approval if a specific Traffic Systems Management program is approved by the Planning Commission. (b) Proposed building and site improvements shall generally comply with conceptual architectural and landscaping plans dated April 6, 1982. Subsequent subdivision and design review applications shall substantially conform to this exhibit. If condominium subdivision of the office buildings is proposed, the TSM program must specifically address measures to ensure that the program can be implemented and monitored given multiple ownerships. The TSM program shall be subject to approval by the Planning Commission. (c) The rezoning shall be valid for 18 months, or until September 23, 1984, and shall expire if a design review application is not approved by that time. Timing of improvements for the project shall be subject to Planning Commission approval at the time of design review.
