LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City do hereby certify that the foregoing Charter Ordinance No. 1312 entitled: AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 5, CHAPTER 5.60, SECTION 5.60.010, PARKING METER ZONES, AND SECTION 5.60.070, TWO HOUR PARKING METER ZONES, BY ADDING THERETO ADDITIONAL PARKING LOT FACILITIES (Two-hour parking meter zones on Tamalpais Avenue) is a true and correct copy of an ordinance of said City and was introduced and adopted as an Urgency Ordinance of the City of San Rafael at a regular meeting of the City Council of San Rafael held on the sixth day of November, 1978, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None and was published as required by the City Charter in the Independent - Journal, a newspaper printed and published in the City of San Rafael. ORDINANCE NO. 1312 AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL AMENDINS TITLE 5, CHAPTER 5.60, SECTION 5.60.010, PARKING METER ZONES, AND SECTION 5.60.070, TWO HOUR PARKING ME.PER ZONES, BY ADDING ADDITIONAL PARKING LOT FACILITIES THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Chapter 5.60 of Title 5, Section 5.60.010 is hereby amended to read: West side of Tamalpais Avenue from Third Street to Fourth Street and east side of Tamalpais Avenue which lies easterly of Northwestern Pacific Railroad tracks; DIVISION 2. Chapter 5.60 of Title 5, Section 5.60.070 is hereby amended by adding the following parking as a facility: Section 5.60.070: Two hour parking meter zones. (a) Ten meters on east side of Tamalpais Avenue which lies easterly of Northwestern Pacific Railroad tracks; DIVISION 3. This Ordinance is an Urgency Ordinance for the immediate pre- servation of the public peace, health, or safety within the meaning of the Government Code Section 25123 and shall go into effect immediately. The facts constituting such necessity are: Recent development has produced increased traffic, aggravating a present deficiency in short-term commercial parking. By adding these meters this situation will be substantially improved. DIVISION 4. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. - � C.
