hereby certify that the foregoing Charter Ordinance Mo. 1204
entitled:
An Ordinance of the City of San Rafael amending Title 10,
Chapter 10.04 entitled Business License, by Adding Sub-
paragraph (Z) Auctions to Section 10.04.050, and by amend-
ing Section 10.04.080 thereof.
is a true and correct copy of an ordinance of said City, and
was introduced at a regular meeting of the
City Council of the City of San Rafael, held on,the 1St
day of December 19 75 Published,as re-
quired by City Charter in the Independent Journal
a newspaper printed and published in the City of San Rafael and
passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City held on the
15th day of December 19 75 by the following

ORDINANCE NO. 1204
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 10, CHAPTER 10.04
ENTITLED BUSINESS LICENSE, BY ADDING SUBPARAGRAPH (Z) AUCTIONS TO
SECTION 10.04.050, AND BY AMENDING SECTION 10.04.080 THEREOF
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Municipal Code of the City of San Rafael
is hereby amended thereto by adding subparagraph (Z) to Section
10.04.050 which shall read as follows:
10.04.050 (Z) Auctions: For operating an auction, for
the first day of auction each month, One Hundred Dollars ($100.00),
and for each subsequent day in any one month Five Dollars ($5.00);
provided that any regularly established livestock auction or an
establishment of a fixed place of business for the auction of objects
of art or jewelry or used items originating in the City shall be
subject only to the regular retail business tax pursuant to Section
10.04.040.
DIVISION 2. Section 10.04.080 of the Municipal Code of the
City of San Rafael is hereby amended and shall read as follows:
10.04.080 DELINQUENCY. Any person who fails to file any
required statement and pay the amount of the license fee prescribed
herein within thirty days after it becomes due, is delinquent and
shall be assessed a penalty of 25% on said amount due which shall
become part of the license fee then required to be paid hereunder.
For each additional thirty day period that the amount remains unpaid,
an additional loo penalty shall be assessed, the total amount of
penalties assessed however not to exceed 100% of the total original
business license tax amount in any one year; any person who becomes
delinquent under the provisions of this Chapter shall be, in addition
to the penalties as set forth above, subject to all other penal pro-
visions and remedies contained herein.
DIVISION 3. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have

adopted the Ordinance and each section, subsection, sentence, clause
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be declared
invalid.
DIVISION 4. This Ordinance shall be published once in
full before its final passage in the Independent.•Journal , a news-
paper of general circulation, printed, published, and circulated in
the City of San Rafael, and shall be in full force and effect thirty
(30) days after its final passage.

San Rafael, held on the 1st day of December , 1975, and
ordered passed to print by the following vote, to -wit:

ABSENT: COUNCILMEN: None
and will come up for adoption as an Ordinance of the City
