RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ACCEPTING GRANT DEED OF EASEMENT FOR LEVEE PURPOSES (440
CANAL STREET, APN. 14-194-02)
WHEREAS, public interest, convenience and welfare require that the easement
hereinafter mentioned be accepted and used for the benefit of the public of the City of San
Rafael, California;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of San Rafael, California, that that certain grant deed of easement for the
construction and maintenance of a levee, breakwater, bulkhead and/or walls of rock or
other material to protect the streets, places, public ways, and other property from
overflow of water upon and over a portion of that certain real property situated in the City
of San Rafael, executed by Ted A. Varlow, Janice C. Varlow, and Michael E. Gottlieb to
the City of San Rafael, dated November 21, 2001, be and the same is hereby accepted and
the Clerk of said City is hereby directed to cause said conveyance to be duly recorded in
the office of the County Recorder of the County of Marin, State of California, forthwith
upon the adoption of this resolution.

certify that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City held on the 17th. day of December, 2001, by
the following vote, to wit:

Ted A. Varlow, Janice C. Varlow, and Michael E. Gottlieb:
Grants to the City of San Rafael, a Municipal Corporation, an Easement for the purposes
of construction and maintenance of a levee, breakwater, bulkhead, and/or walls of rock or
other material, to protect the streets, places, public ways, and other property in the City of
San Rafael from overflow of water upon and over a portion of that certain real property
situated in the City of San Rafael, County of Marin, State of California, described in the
Grant Deed from Michael E. Gottlieb, Trustee of the Michael E. Gottlieb 1992 trust, and
Ted A. Varlow to Canal Water Front Lofts, LLC, a Limited Liability Company, recorded
September 1, 2000 as D.N. 00-0050450, Marin County Records, described as follows:
Beginning at a point distant North 35° 18' 00" East 104.34 feet from the Southwesterly
corner of Lot G as shown upon that certain Map entitled "Map of East San Rafael, Marin
County Calif." filed for record January 21, 1908 in Book 2 of Maps at Page 109.
1. Thence along the Westerly boundary line of said Lot G North 35° 18' 00" East 20.26
feet
2. Thence leaving said Westerly boundary line South 63° 57' 59" East 30.40 feet,
3. Thence South 35° 18' 00" West 20.26 feet,
4. Thence North 63° 57' 59" West 30.40 to the point of beginning.
