San Pedro Rd)RESOLUTION NO. 10895 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING AN AMENDMENT TO THE PEACOCK GAP NEIGHBORHOOD PLAN TEXT AND MAP TO REDESIGNATE THE ROMAN CATHOLIC CHURCH (ST. SYLVESTER'S CHURCH) SITE TO ALLOW 15 SINGLE-FAMILY DWELLING UNITS, RETENTION OF THE HISTORIC CHAPEL AND RELATED PARKING, AND OPEN SPACE AT 1115 POINT SAN PEDRO ROAD (APN 184-052-08) WHEREAS, the Peacock Gap Neighborhood Plan was adopted by the San Rafael City Council in Resolution No. 6038 on December 15, 1980; and WHEREAS, on March 1, 2000, Paramount Homes submitted applications to the City of San Rafael requesting approval of a planned development to create 15 residential lots for 13 market rate detached single-family homes, two attached below market rate homes, a 0.64 -acre private park, streets, landscaping, easements for drainage and landscaping across a drainage ditch and for private open space across the wooded eastern hillside, and two parcels ("A" and `B") to be retained by the Archdiocese of San Francisco for the historic St. Sylvester's Chapel and related parking; and WHEREAS, an application to amend the Peacock Gap Neighborhood Plan was filed concurrent with applications requesting a Rezoning, Master Use Permit, Environmental and Design Review Permit, and Vesting Tentative Parcel Map to permit a greater number of residential units on the Roman Catholic Church (St. Sylvester's Church) site than had been planned in the 1980 Peacock Gap Neighborhood Plan due to the subsequent decision of the Archdiocese of San Francisco to close the Church and Rectory and sell this portion of the site (8.29 acres) for private development, while retaining ownership of 1.12 acres, including the historic St. Sylvester's Chapel and related parking; and WHEREAS, upon review of the subject applications an Initial Study was prepared consistent with the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the City Council approved a Mitigated Negative Declaration for the project by adoption of a separate resolution; and WHEREAS, on May 29, 2001, the Planning Commission held a public hearing on the proposed amendment to the Peacock Gap Neighborhood Plan, accepting public testimony and the written report of the Department of Community Development; and 1 URMNA , \otos WHEREAS, on May 29, 2001, the Planning Commission voted to recommend approval of the proposed amendment to the Peacock Gap Neighborhood Plan in Resolution No. 01-31; and WHEREAS, on August 6, 2001, the City Council held a public hearing on the proposed amendment to the Peacock Gap Neighborhood Plan, accepting public testimony and the written report of the Department of Community Development. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael does hereby adopt the proposed amendment to the Peacock Gap Neighborhood Plan, as indicated in Attachments "A" and `B" and based on the following finding: The public interest would be served by the adoption of the proposed amendment to redesignate the Roman Catholic Church (St. Sylvester's Church) site from 6-10 single-family detached units to 15 single-family units, with designations for church use and open space in that the amendment would be consistent with the General Plan land use designation for the site of Low Density Residential 2.0-6.5 units per acre. The proposed planned development would provide a residential density of 2.5 units per acre on approximately 6 acres of the site and a buffer of private open space and park area totaling approximately 2.3 acres. The remaining 1.1 acres would include the historic Chapel and related parking. Furthermore, the public welfare of the community would be served by adoption of the proposed amendment in that it would allow redevelopment of the site which is now in a derelict state with a high quality residential neighborhood, including an open space/park buffer that is consistent with the character of the surrounding single- family residential neighborhood. Page 6: Delete the following text: Roman Catholic Church (Parcel 7, Map P1) On the land surrounding the church, six to ten single detached dwellings are proposed. Lots would be similar to existing surrounding residential development with access off Point San Pedro Road. Insert the following revised text: Roman Catholic Church (Parcel 7, Map P1) On the land surrounding the historic Chapel and its parking lot, 15 single- family units are permitted along with a buffer of private open space and park area around the site perimeter. Residential lots would be similar to existing surrounding residential development with access off Point San Pedro Road. B. Page 28: Delete the following text: Roman Catholic Church (Parcel 7, Map P1) No significant constraints to development exist on this Parcel. Single family detached units are appropriate because of adjacent development on San Marcos Place, Riviera and San Marino Drives. Six to ten lots can be located within the development envelope shown in Map P2. Care will be required to ensure that the subdivision buffers the new lots from Church traffic and other activities. Insert the following revised text: Roman Catholic Church (Parcel 7, Map P1) No significant constraints to development exist on this Parcel. Single family units are appropriate because of the adjacent development on San Marcos Place, Riviera and San Marino Drives. Fifteen lots can be located within the development envelope shown in Map P2. 4
