RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DENYING THE APPEAL
AND APPROVING A MODIFIED SIGN PROGRAM FOR A
PROFESSIONAL/OFFICE BUILDING LOCATED AT
550 LAS GALLINAS AVENUE
(SR99-24), APN 175-331-20
WHEREAS, on May 27, 1999 the City of San Rafael (City) received an
application for a Sign Program (SR99-24) from Neil Kuvara for the office building
located at 550 Las Gallinas Avenue; and,
WHEREAS, a public notice describing the proposed Sign Program was mailed to
property owners within 300 feet of the site; and,
WHEREAS, the proposed Sign Program is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA
Guidelines Section 15311 (a), (Accessory Structures) and the City of San Rafael
Environmental Assessment Procedures Manual under Class 11 (a) construction or
placement of minor structures accessory or appurtenant to the existing facility including
on -premises signs; and,
V4'11EREAS, on October 17, 2000, the San Rafael Design Review Board
considered the Sign Program for the 550 Las Gallinas Avenue office building and
recommended denial; and
WHEREAS, on February 27, 2001, the San Rafael Planning Commission held a
duly noticed public hearing on the Sign Program, accepted all oral and written public
testimony and the written report of the Community Development Department staff and
voted to deny said application for a master sign program; and
WHEREAS, on March 6, 2001, Perry Litchfield, Esq. appealed the Planning
Commission's denial of the Sign Permit for the master sign program; and
WHEREAS, The City Council opened the public hearing on the appeal on May
21, 2001, and continued the public hearing subject to review of an alternative Sign
Program by the Design Review Board; and
WHEREAS, the Design Review Board reviewed the revised sign program on May
22, 2001 and recommended approval of the modified sign program with the provision
that the wall sign be individual letters externally illuminated; and
WHEREAS, the City Council considered the appeal and reviewed the
recommendations of the Design Review Board and received public testimony on this item
from all interested parties:
NOW, THEREFORE BE IT RESOLVED that the San Rafael City Council hereby
denies the appeal and approves the modified sign program presented to the City Council
on June 4, 2001 based on the following findings:
1. The City Council finds that the grounds specified in the
appeal from the denial of the original sign program are
lacking in merit for the reasons set forth in the Staff Report,
and specifically finds that the original sign program as
proposed by the applicant is not in harmony with the
materials, color, architecture and design features of the
building.
2. The San Rafael City Council finds that the modified sign
program is in harmony with the materials, color,
architecture and design features of the building, and that the
signs have been designed in scale with the building
3. The applicant's modified Sign Program was reviewed and
recommended for approval by the Design Review Board
with the provision that the wall sign contain individual
externally illuminated letters and that the monument sign
contain a color band on the top similar to the base color.
The Council has considered the modification to the original
submittal and finds the sign program as modified is in
harmony with the Design Review Board's
recommendations for a Sign Program and is consistent with
the architecture of the building.

resolution was duly and regularly introduced and adopted at a regular meeting of the Council of
said City on Monday, fourth day of June, 2001, by the following vote, to wit:
