HomeMy WebLinkAboutCC Resolution 10769 (Dominican Estates)RESOLUTION NO. 10769 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A MITIGATED NEGATIVE DECLARATION FOR A PLANNED DEVELOPMENT (PD) ZONING ORDINANCE AMENDMENT (ZC 00-7), MASTER USE PERMIT (UP 00-30), ENVIRONMENTAL AND DESIGN REVIEW PERMIT (ED 00-85) AND TENTATIVE PARCEL MAP (S 00-4) FOR A THREE LOT, SINGLE-FAMILY RESIDENTIAL SUBDIVISION DEVELOPMENT LOCATED AT HIGHLAND AVENUE AND DEER PARK AVENUE (Dominican Estates) (Located at the intersection of Highland Avenue and Deer Park Avenues) (APNs 015-163-02 AND 04) The City Council of the City of San Rafael finds and determines that: WHEREAS, on July 19, 2000, planning applications that were submitted by Waterford Associates requesting approval of a master planned development of a 6.69 acre hillside/ridgeline parcel with three single family residences were reviewed and deemed complete by the Community Development Department, Planning Division; and WHEREAS, consistent with the requirements of the City of San Rafael Environmental Review Procedures and the provisions of the California Environmental Quality Act (CEQA), an Initial Study/Mitigated Negative Declaration was prepared finding that the proposed project would not result in significant environmental effects, in that revisions to the project have been made and mitigation measures are required to mitigate potential adverse impacts to less -than - significant levels; and WHEREAS, consistent with the provisions of CEQA, a Mitigation Monitoring and Reporting Program has been prepared to implement the project mitigation measures and to accompany the Mitigated Negative Declaration; and WHEREAS, pursuant to California Government Code Section 15105(b) notices regarding the Initial Study/Mitigated Negative Declaration prepared for this project were: a) posted on-site and off-site, and published in a local newspaper of general circulation in the area; b) provided to the County Clerk; and c) mailed to surrounding property owners within 300 feet, pertinent agencies (including responsible and trustee agencies), organizations and special interest groups; and WHEREAS, copies of the Initial Study/Mitigated Negative Declaration were made available for a 20 -day review period by pertinent agencies and interested members of the public, commencing on December 20, 2000; and WHEREAS, on January 23, 2001, the Planning Commission held a public hearing on the proposed Initial Study/Mitigated Negative Declaration, accepting public testimony and the r'dI�. written report of the Department of Community Development. On a 5-0-2 vote (Commissioners Kirchmann and O'Brien absent) adopted Resolution 01-01 recommending that the City Council adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael hereby adopts the Mitigated Negative Declaration and approves of the Mitigation Monitoring and Reporting Program as presented in Exhibit "A" based on the findings that: a) Adoption of the Mitigated Negative Declaration is consistent with the provisions of the California Environmental Quality Act (CEQA) in that: a) an Initial Study has been prepared on the project, which concludes that, with incorporation of project revisions and implementation of required mitigation measures, the project will have a less -than - significant impact on the environment; b) revisions have been made to the design and mitigation measures have been incorporated into the project which reduce the potential impacts to a level of insignificance; c) public notice of the intent to adopt the Mitigated Negative Declaration and circulation of the document have been completed pursuant to state law; d) the proposed Negative Declaration has been considered in conjunction with any and all comments received during the public review period and at the public hearings; and, d) the recommendation to adopt the Mitigated Negative Declaration reflects the independent judgement of the City Council. b) A mitigation monitoring and reporting program has been prepared for adoption to ensure implementation of, and compliance with, all conditions required to mitigate any impact to a level of insignificance.
