RESOLUTION AMENDING THE MASTER FEE SCHEDULE TO
ESTABLISH APPLICATION FEES FOR PROCESSING PERMITS
REQUIRED FOR OFFICES, ESTABLISHMENTS AND PRACTITIONERS
PROVIDING MASSAGE/BODYWORK SERVICES.
WHEREAS,
the City
Council has
adopted new
Chapter
8.34 of the
San Rafael
Municipal Code
regulating
offices,
establishments
and
practitioners
providing
massage/bodywork services; and
WHEREAS, Section 8.34.050 of the San Rafael Municipal Code provides that the City
Council may establish, by Resolution, application fees to defray the City's costs in processing
applications required for offices, establishments and practitioners providing massage/bodywork
services; and
WHEREAS, the Police Department conducted a study and assembled data concerning
the costs reasonably borne by the City in processing the aforementioned applications, which
documentation has been made available for public review pursuant to Section 3.34.060 of the
San Rafael Municipal Code; and
WHEREAS, the Police Department has proposed an amendment of the Master Fee
Schedule adopted by City Council Resolution No. 10522, on November 1, 1999, to establish
application fees to cover the processing of the aforementioned applications; and
WHEREAS, the City Council finds that the proposed application fees are necessary and
do not exceed the City's reasonable costs of providing said services; and
WHEREAS, the City Council finds that adoption of this Resolution establishing
application fees to cover the processing of the aforementioned applications is exempt from the
California Environmental Quality Act (CEQA), pursuant to Public Resources Section

21080(b)(8), as the establishment and modification of charges by a public agency to meet
operating expenses.
NOW THEREFORE BE IT RESOLVED that Item 03.16 in Table 1 of the City's
Master Fee Schedule, approved by Resolution No. 10522, is hereby amended to establish the
application fees for processing the applications required for offices, establishments, and
practitioners providing massage/bodywork services, as set forth in Exhibit "A" attached hereto,
and will be in full force and effect thirty (30) days following final adoption of Ordinance No.
1761.

the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of
