RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ADOPTING A POLICY FOR PUBLIC USE OF THE INTERNET
WITHIN THE SAN RAFAEL PUBLIC LIBRARY
WHEREAS, the Internet offers a vast array of information that can be personally,
professionally and culturally enriching; and
WHEREAS, public access to the Internet is an important service offered by the San
Rafael Public Library; and
WHEREAS, establishing a policy for children's use of the Internet will bring the Library
into compliance with California State Education Code Section 18030.5 which requires that public
libraries adopt a policy regarding minors' access to the Internet.
NOW, THEREFORE, BE IT RESOLVED that City Council of the City of San Rafael
hereby adopts a Library Internet Use Policy (attached hereto as Exhibit A), and a San Rafael
Public Library Children's Internet Policy (attached hereto as Exhibit B).

foregoing resolution was duly and regularly introduced and adopted at a Regular meeting of the
City Council of said City held on Monday the Seventh day of February 2000 by the following vote
to wit:

San Rafael Public Library
Internet Use Policy
The San Rafael Public Library provides access to the Internet. The Library's Internet
access is intended primarily as an information resource.
The Internet allows users to connect to a vast array of information that can be
personally, professionally and culturally enriching. The San Rafael Public Library has
no control over the content of there resources nor does the Library have complete
knowledge of what is available on the Internet. Library staff and the InfoPeople Project
have attempted to identify specific starting points for searches and links to sources on
the Internet which are consistent with the Library's mission and organizational values.
Sites on the Internet change so often and unpredictably and the Library cannot protect
users from information and images which they may find offensive or disturbing. Library
patrons use the Internet at their own discretion.
The Internet contains some material that is inappropriate for viewing or reading by
children. Parents are expected to monitor and supervise their children's use of the
Internet. The Library staff is not in a position to provide this monitoring or supervision.
The Library staff shall develop rules and procedures as necessary to insure fair and
reasonable use of the Internet resources.
Information on the Internet may be reliable and current or it may be inaccurate, out-of-
date or unavailable at times. Users are encouraged to use critical judgment in
evaluating sites accessed on the Internet. The San Rafael Public Library assumes no
responsibility for any damages, direct or indirect, arising from its connection to the
Internet.
Library staff will assist users with the Internet as time permits, but cannot offer personal
instruction. Formal instruction or information on Internet use may be offered at
designated times. Users are encouraged to take advantage of the Internet and to
exercise good judgment and discretion in the use of it. Users are cautioned that the
computer that which provides access to the Internet is located in an area which must be
shared by Library users of all ages, backgrounds and sensibilities. Users are asked to
respect the sensibilities of others when accessing potentially offensive information and
images. Use of Library computers for viewing or disseminating illegal images is not
permitted. The San Rafael Public Library is bound by an agreement with our Internet
provider. This agreement prohibits any unlawful use of the Internet. Patrons who make
any unlawful use of the Internet may be banned from using the Library's Internet
resources and may be prosecuted.
Misuse of the Internet privileges or any violation of our policies may result in the
withdrawal or suspension of access privileges.

San Rafael Public Library Children's Internet Policy
The San Rafael Public Library encourages lifelong learning,
promotes literacy, and provides access to library materials and
information services for all. As with our print collection, we have
carefully selected our on-line sites. In order to meet a wide variety
of information needs, the Library makes information available in a
variety of formats and provides access to the information resources
of the Internet.
We ask that all our patrons read the San Rafael Library's
Internet Use Policies and sign the applicant agreement. Parents
should discuss these policies and the Rules for On-line Safety with
their children. Children under the age of 14 must have a parent or
guardian co-sign their agreements.
* Purpose: Computers are for information, research, and the
support of educational assignments.
* Privacy: Please respect the privacy rights of other users.
* Security: In order to protect our computers from viruses or
other problems, access to the hard drives has been disabled. If you
wish to save files, you will need to use the Adult Reference
computers.
* Email: If you wish to check your email, please use the Adult
Reference computers.
* Access Problems: There are many reasons why you may not
be able to access a particular website, or may experience difficulty
during your session.. We do not have the staff to troubleshoot the
problem you may be experiencing.

The following is a list of unacceptable uses:
* Display of offensive information and images is inappropriate for a
public and open environment.
* Use of the Library's Internet access for any illegal purpose.
* Vandalism of library property, including the violation of the Library's
network security, or the attempt to harm or destroy data of another
user, or on other networks connected to the Internet.
* Violation of copyright laws or licensing agreements.
Misuse of the Internet privileges or any violation of our policies may result
in the withdrawal or suspension of access privileges.
