HomeMy WebLinkAboutCC Resolution 10609 (Transportation Grant Funding)RESOLUTION NO. 10609 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE PUBLIC WORKS DIRECTOR OR DEPUTY DIRECTOR TO FILE AN APPLICATION AND BE THE SIGNATORY FOR FEDERAL SURFACE TRANSPORTATION PROGRAM (STP) AND CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM (CMAQ) FUNDING FOR TOTAL OF $662,000.00 TO THE FOLLOWING PROJECTS: I. STP 75% PROGRAM: 1. FOURTH STREET REHABILITATION $200,000.00 II. STP 25% CORRIDOR PROGRAM: 1. DOWNTOWN TRAFFIC SIGNAL COORDINATION $180,000.00 2. N. SAN PEDRO RD./CIVIC CENTER DR. TRAFFIC IMPROVEMENT (CO-SPONSORED WITH MARIN CO.) $282.000.00 TOTAL: $662,000.00 THIS RESOLUTION COMMITS THE NECESSARY LOCAL MATCH FOR THE PROJECTS AND ALSO STATES THE ASSURANCE OF THE CITY OF SAN RAFAEL TO COMPLETE THE PROJECTS. BE IT RESOLVED by the Council of the City of San Rafael as follows: WHEREAS, the City of San Rafael (City) under Article III of its charter has power to enter into contracts and to provide for the construction and repair of public streets; and WHEREAS, the Transportation Equity Act for the 215` Century (TEA 21) (Public Law 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105- 206, July 22, 1998) continue the Surface Transportation Program (STP) (23 U.S.C.s 133) �]� ��� 1 q and the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C.s 149); and WHEREAS, pursuant to TEA 21, and the regulations promulgated thereunder, eligible project sponsors wishing to receive Surface Transportation Improvement Program or Congestion Mitigation and Air Quality Improvement Program grants for a project shall submit an application first with the appropriate metropolitan transportation planning organization (MPO), for review and inclusion in the MPO's Regional Transportation Improvement Program (RTIP); and WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the San Francisco Bay region; and funds; and WHEREAS, the City is an eligible project sponsor for STP or CMAQ WHEREAS, the City wishes to submit a grant application to MTC for funds from the STP or CMAQ in fiscal year 2000/2001 and 2001/2002 for the following projects: I. STP 75% Program for Fiscal Year 2000/2001: 1. Fourth Street Rehabilitation $200,000.00 II. STP 25% Corridor Program for Fiscal Year 2001/2002: 1. Downtown Traffic Signal Coordination $180,000.00 2. N. San Pedro Rd./Civic Center Dr. Traffic Improvement (Co-sponsored with Marin Co.) $282,000.00 TOTAL: $662,000.00 2 following: WHEREAS, MTC requires, as part of the application, a resolution stating the 1) The commitment of necessary local matching funds of at least 11.5%; and 2) That the sponsor understands that the STP or CMAQ funding is fixed at the programmed amount, and therefore any cost increase cannot usually be expected to be funded with STP or CMAQ funds; and 3) The assurance of the sponsor to complete the project as described in the application, and if approved, as programmed in MTC's TIP. 4) That the sponsor understands that funds must be obligated by September 30, 2002, or the project may be removed from the program. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael that the Public Works Director or Deputy Director is authorized to execute and file an application and be the signatory for funding under the STP or CMAQ of TEA 21 in the total amount of $662,000.00 for the above-mentioned projects; and RESOLVED, FURTHER, that the Council, by adopting this Resolution, does hereby state that: 1) The City will provide $49,000.00 (11.5%) in local matching funds for Fourth Street Rehabilitation and Downtown Traffic Signal Coordination projects; and 2) The City and Marin County will provide $367,500.00 each in local matching funds for the N. San Pedro/Civic Center Drive Traffic Improvement; and 3 3) The City understands that the STP or CMAQ funding for these projects is fixed at $662,000.00 and that any cost increases must be funded by the City from local matching funds, and that City does not expect any cost increases to be funded with STP or CMAQ funds; and 4) The projects mentioned above will be built as described in this Resolution, and, if approved, as programmed in Metropolitan Transportation Commission (MTC) Transportation Improvement Program (TIP) 5) The program funds are expected to be obligated by September 30, 2002. RESOLVED, FURTHER, that a copy of this Resolution will be transmitted to the MTC in conjunction with the filing of the application; and RESOLVED, FURTHER, that the MTC is requested to support the application for the project described in the Resolution and to program the project, if approved, in MTC's TIP.
