RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A NEGATIVE
DECLARATION FOR THE SAN RAFAEL GENERAL PLAN 2000 AND ZONING
ORDINANCE TEXT AMENDMENTS TO AFFORDABLE HOUSING POLICIES,
PROGRAMS AND PROVISIONS FOR NEW BELOW MARKET RATE RENTAL UNITS
(GPA 99-5 and ZC 99-8)
The City Council of the City of San Rafael finds and determines that:
WHEREAS, in January 2000, the City of San Rafael initiated amendments to specific
policies, programs and provisions of the San Rafael General Plan 2000 and Section 14.16.030 of
the San Rafael Municipal Code with the intent to lower the affordable housing standards for new
below market rate (BMR) rental units; and
WHEREAS, consistent with the requirements of the City of San Rafael Environmental
Review Procedures and the provisions of the California Environmental Quality Act (CEQA), an
Initial Study/Negative Declaration was prepared finding that the proposed project would not
result in environmental effects; and
WHEREAS, notices regarding the Initial Study/Negative Declaration prepared for this
project were a) mailed to pertinent agencies, organizations and special interest groups and b) sent
to the State Clearinghouse of the State of California Department of Planning and Research
pursuant to California Government Code Section 15105(b); and
WHEREAS, copies of the Initial Study/Negative Declaration were made available for a
30 -day review period by pertinent agencies and interested members of the public, commencing
on January 29, 2000; and
WHEREAS, on February 29, 2000, the Planning Commission held a public hearing on
the proposed Initial Study/Negative Declaration, accepting public testimony and the written
report of the Department of Community Development. On a 5-0-2 vote (Atchison and O'Brien
absent) recommended to the City Council the adoption of the Negative Declaration; and
WHEREAS, on March 20, 2000, the City Council held a public hearing on the proposed
Initial Study/Negative Declaration, accepting public testimony and the written report of the
Department of Community Development.
NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council does
hereby adopt the Negative Declaration based on the findings that a) the Initial Study/Negative
Declaration has been prepared in accordance with the requirements of the City of San Rafael
Environmental Review Procedures and the provisions of the California Environmental Quality
Act (CEQA) and b) that the project will not result in a significant effect on the environment.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the
City Council held on Monday, the twentieth of March, 2000, by the following vote to wit:
AYES: Councilmembers: Cohen, Miller, Phillips and Vice -Mayor Heller
NOES: Councilmembers: None
ABSENT: Councilmembers: Mayor Qoro
