HomeMy WebLinkAboutCC Resolution 10614 (General Plan 2000 Amendment)RESOLUTION NO. 10614 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A NEGATIVE DECLARATION FOR AN AMENDMENT TO THE SAN RAFAEL GENERAL PLAN 2000 TO UPDATE APPENDIX B (LAND USE TRAFFIC ALLOCATIONS) (GPA 99-4) The City Council of the City of San Rafael finds and determines that: WHEREAS, Circulation Element Policy C-4 (Trip Allocations) of the San Rafael General Plan 2000 notes that, in most traffic sensitive areas of the City, individual parcels/sites have been assigned a proportion of area trips based on maximum development potential of such sites and estimated PM peak hour trip generation. This trip assignment is necessary in order to achieve and maintain City -adopted level -of -service standards at local intersections. The parcel - by -parcel assignment of PM peak hour trips is presented in Appendix B (Land Use Traffic Allocations) of the General Plan. Policy C-4 also recognizes that Appendix B must be updated periodically to delete approved and built development projects. Appendix B was last updated in 1991; and WHEREAS, in December 1999, the City of San Rafael initiated an update of Appendix B of the San Rafael General Plan 2000, in order to recognize development projects that have been approved and developed since 1991 and to update trip reserves; and WHEREAS, consistent with the requirements of the City of San Rafael Environmental Review Procedures and the provisions of the California Environmental Quality Act (CEQA), an Initial Study/Negative Declaration was prepared finding that the proposed update of Appendix B would a) not result in significant environmental effects or b) not result in any changes in the current traffic modeling assumptions for the planning area; and WHEREAS, a notice regarding the availability of the Initial Study/Negative Declaration was prepared and published, and the document was made available for public review; and WHEREAS, on February 29, 2000, the Planning Commission held a public hearing on the proposed Initial Study/Negative Declaration, accepting the written report of the Department of Community Development. On a 5-0 vote (Atchison and O'Brien absent) recommended to the City Council the adoption of the Negative Declaration; and WHEREAS, on March 20, 2000, the City Council held a public hearing on the proposed Initial Study/Negative Declaration, accepting public testimony and the written report of the Department Of Community Development. NOW, THEREFORE BE IT RESOLVED, that the San Rafael City Council does hereby adopt the Negative Declaration based on the findings that a) the Initial Study/Negative Declaration has been prepared in accordance with the requirements of the City of San Rafael Environmental Review Procedures and the provisions of the California Environmental Quality Act (CEQA) and b) that the project will not result in a significant impact on the environment.
