RESOLUTION NO. 10622
RESOLUTION OF THE SAN RAFAEL CITY COUNCIL MAKING FINDINGS
REQUIRED BY HEALTH AND SAFETY CODE SECTION 33445,
RELATING TO FUNDING OF CERTAIN SCHOOL IMPROVEMENTS
AND TAKING RELATED ACTIONS
WHEREAS, the City Council of the City of San Rafael (the "City Council") adopted the
Redevelopment Plan for the Central San Rafael Redevelopment Project Area on November 20,
1972, by Ordinance No. 1079, and adopted the Second Amended and Restated Redevelopment
Plan for the Central San Rafael Redevelopment Project Area (the "Redevelopment Plan") on
October 5, 1998, by Ordinance No. 1732; and
WHEREAS, pursuant to the Community Redevelopment Law (Health and Safety Code
Section 33000 et seq., (the "Law")), the San Rafael Redevelopment Agency (the "Agency") is
vested with responsibility to implement the Redevelopment Plan and receives tax increment
revenue to fund the implementation of the Redevelopment Plan; and
WHEREAS, on July 19, 1999, the Agency and the City Council approved funding
certain facilities for the San Rafael Elementary and San Rafael High School Districts (the
"Districts") for schools within the Project Area and that serve Project Area residents; and
WHEREAS, the Districts desire to add certain types of improvements (the
"Improvements") to the types of improvements for which the Agency will provide funding as set
forth in the attached Addendum to Public Improvement List; and
WHEREAS, the Agency desires to spend funds for the Improvements; and
WHEREAS, installation of the Improvements conforms with the General Plan of the
City; and
WHEREAS, the Agency expenditures for the Improvements will improve educational
opportunities and provide expanded economic opportunities in the community, thus assisting in
the redevelopment of the Project Area; and
WHEREAS, the Districts have provided information to the City and the Agency
demonstrating that, due to the limited resources available to school districts, the Districts have no
other means of financing the Improvements; and

WHEREAS, pursuant to Section 33445 of the Law, the Agency may, with the consent of
the City Council, pay part or all of the cost of the Improvements if the City Council and the
Districts make certain specified findings.
NOW, THEREFORE, IT IS HEREBY RESOLVED that based on information
presented to the City Council, the Agency and the Districts, and in compliance with the
requirements of Section 33445 of the Law, the City Council resolves that:
1. All of the above recitals are true and correct, and the City Council has based the findings and
actions set forth in this Resolution, in part on such recitals.
2. The City Council hereby finds and determines that: (a) the Improvements will be of benefit
to the Project Area; (b) no other reasonable method of financing the Improvements is
available to the community; (c) the Improvements will assist in the elimination of one or
more blighting conditions inside the Project Area; and (d) Agency assistance with the
Improvements is consistent with the Agency's current Implementation Plan. The factual and
analytical basis used by the City Council in making these findings and determinations is set
forth in the staff report and materials regarding the Improvements provided to the City
Council.
3. The City Council consents to the expenditure of Agency funds for the Improvements.
4. The attached Exhibit A is incorporated into this Resolution by this reference.
5. This Resolution shall take immediate effect from and after its passage and approval.

foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the
San Rafael City Council held on April 3, 2000, by the following vote, to wit:

EXHIBIT A
ADDENDUM TO PUBLIC IMPROVEMENTS LIST FOR FACILITIES OWNED OR
OPERATED BY THE SAN RAFAEL ELEMENTARY SCHOOL DISTRICT AND THE
SAN RAFAEL HIGH SCHOOL DISTRICT
Agency funds will be utilized for projects at all of the following schools: Bahia Vista,
Coleman, Glenwood, Gallinas, Old Gallinas, San Pedro, Short School, Laurel Dell, Sun Valley,
Davidson, San Rafael High School, Madrone High School and Terra Linda High School.
In addition to the project list adopted on July 19 1999 by the City Council and the
Redevelopment Agency, the San Rafael Elementary and High School Districts may also expend
Agency funds on capital equipment.
