HomeMy WebLinkAboutCC Resolution 10650 (General Plan 2000 Amendment)RESOLUTION NO. 10650 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A NEGATIVE DECLARATION FOR AMENDMENTS TO THE SAN RAFAEL GENERAL PLAN 2000 LAND USE MAP AND TO THE ZONING MAP OF THE CITY OF SAN RAFAEL FOR PROPERTIES LOCATED ON GARY PLACE, FROM "OFFICE" TO "LIGHT INDUSTRIAL/OFFICE" (AP NO. 18-051-01, 12, 13, 16 and 17; 18-063- 04) (GPA 00-01 AND ZC 00-01) The City Council of the City of San Rafael finds and determines that: WHEREAS, on September 30, 1997, Marin County Exchange Corporation submitted an application to the City of San Rafael requesting a General Plan Amendment and Zone Change to re -designate the property at 20-38 Gary Place (APN 18-063-04) from Office to General Commercial; and WHEREAS, on October 25, 1999, the Rasche Trust submitted an application to the City of San Rafael requesting a General Plan Amendment to re -designate the property at 110-200 Gary Place (APN 18-051-17) from Office to Light Industrial Office; and WHEREAS, on January 13, 2000, following review of the individual applications and the status of other individual parcels in the site area, the City of San Rafael Community Development Department initiated amendments to City of San Rafael General Plan and Title 14 of the San Rafael Municipal Code (Zoning Map) to re -designate all of the Gary Place parcels from Office to Light Industrial/Office (LI/0); and WHEREAS, consistent with the requirements of the City of San Rafael Environmental Review Procedures and the provisions of the California Environmental Quality Act (CEQA), an Initial Study/Negative Declaration was prepared finding that the proposed project would not result in significant environmental effects; and WHEREAS, copies of the Initial Study/Negative Declaration prepared for this project were made available for a 30 -day review period by pertinent agencies and interested members of the public, commencing on May 1, 2000; and WHEREAS, on May 23, 2000 the San Rafael Planning Commission held a duly - noticed public hearing on the Initial Study/Negative Declaration, accepting all oral and written public testimony and the written report of the Community Development Department staff. On a 6-0-1 vote (O'Brien absent) recommended to the City Council the adoption of the Negative Declaration; and b� 0 WHEREAS, on June 19, 2000, the City Council held a public hearing on the proposed Initial Study/Negative Declaration, accepting public testimony and the written report of the Department of Community Development. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council does hereby adopt the Negative Declaration based on the findings that a) the Initial Study/Negative Declaration has been prepared in accordance with the requirements of the City of San Rafael Environmental Review Procedures and the provisions of the California Environmental Quality Act (CEQA) and b) that the project will not result in a significant effect on the environment.
