HomeMy WebLinkAboutCC Resolution 10730 (Overcrowding Standard)CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLUTION NO. 10730 ADOPTION OF A LOCAL "OVERCROWDING" STANDARD FOR IMPLEMENTATION OF THE UNIFORM RELOCATION ASSISTANCE & REAL PROPERTY ACQUISITION POLICIES ACT OF 1970 AND CALIFORNIA GOVERNMENT CODE SECTION 7260 ET SEO. WHEREAS, the City of San Rafael and the San Rafael Redevelopment Agency requested the County of Marin change its local standard for the implementation of the Federal Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 to allow two persons in each bedroom and two persons in non -sleeping rooms (2+2) when screening existing tenants for overcrowding when a residential property is being acquired or rehabilitated with Federal funds; and WHEREAS, the County of Marin adopted the requested occupancy standard on August 22, 2000; and WHEREAS, the City of San Rafael desires to adopt a local standard for implementation of the U.S. Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and the relocation requirements of California Government Code Section 7260 et seq. NOW, THEREFORE, IT IS HEREBY RESOLVED that the City of San Rafael does hereby adopt the 2+2 local occupancy standard consistent with the standard adopted by the County of Marin for implementation of the U.S. Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and the requirements of California Government Code Section 7260 et seq. when screening existing tenants for overcrowding in residential properties being acquired or rehabilitated with public funds within their jurisdiction.
