HomeMy WebLinkAboutCC Resolution 10361 (Traffic Signal System at Lucas Valley)RESOLUTION NO. 10361 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE AGREEMENT FOR PROFESSIONAL SERVICES WITH DKS ASSOCIATES TO COVER ADDITIONAL SERVICES TO COMPLETE DESIGN PLANS FOR A TRAFFIC SIGNAL SYSTEM FOR INTERIM SOLUTION FOR THE INTERSECTION OF LUCAS VALLEY ROAD AND SOUTHBOUND 101 RAMPS IN THE AMOUNT OF $2,558.35. BE IT RESOLVED by the Council of the City of San Rafael as follows: WHEREAS, The City Manager and the Public Works Director are hereby authorized to execute, on behalf of the City of San Rafael, an amendment to the agreement between the City of San Rafael and DKS Associates to cover additional services to complete design plans for Lucas Valley Road/South 101 Traffic Signal Installation, a copy of which is attached hereto and incorporated herein; and, WHEREAS, $25,000 shall be funded by the Northgate Traffic Mitigation Fee to design this project. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of San Rafael hereby authorizes the City Manager and Public Works Director to enter into an amendment to the agreement for professional services with DKS Associates to cover additional services to complete design plans for a traffic signal system for the interim solution for the intersection of Lucas Valley Road and Southbound 101 ramps. EONCYNI, City Ierk AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES TO COVER ADDITIONAL SERVICES TO COMPLETE DESIGN PLANS FOR LUCAS VALLEY ROAD/SOUTH 101 TRAFFIC SIGNAL INSTALLATION This Amendment to the original Agreement is made and entered into this 3rd day of December 1998, by and between the CITY OF SAN RAFAEL and DKS Associates. This Amendment covers additions to the original contract which will include the following: • DKS Project Manager arranging a scope of work and sub -contract, reviewing work product and revising DKS's design based on the new information • DKS administration time in administering sub -contract and payments • DKS CAD operator modifying DKS plan set to make layout consistent with curb line and catch basin location on new plan sheet, and include reference to additional sheet. This change to the contract will add an additonal cost of $2,558.35 to the original cost of $21,940.00; total amount of compensation will now be $24,498.35. All the additional work will be in accordance with the attached proposal dated December 3, 1998 and attached herein as "Attachment A". Box 151560 San Rafael, California 94915-1560 Subject: Lucas Valley Road / US101 Signal Design P96295x0 Dear Mr. Preston: I am writing to request a variation to our existing contract for this project to cover additional services required to complete the design plans, which are beyond our agreed scope of work. As you are aware, when we agreed on the scope of work, it was assumed that base plans would be provided by the City in AutoCAD format, and that there would be no need for DKS to undertake a topographic survey. Following Caltrans' review of the draft design plans in late 1997, it became clear that the elevations and coordinates included in the base provided by the City were not sufficiently accurate to be used for the construction of a new curb and catch basin. It was verbally agreed with Mr. Paul Olson (then at DKS Associates) that DKS would undertake a survey and complete the civil design to meet Caltrans' requirements. DKS arranged for CSW/Stuber-Stroeh to undertake the survey and prepare an additional plan sheet with the appropriate details. The additional tasks we undertook to facilitate this work included: • Project Manager arranging scope of work and sub -contract, reviewing work product and revising DKS's design based on the new information; • Administration time in administering sub -contract and payments • CAD operator in modifying DKS plan set to make layout consistent with curb line and catch basin location on new plan sheet, and include reference to additional sheet. December 3, 1998 Page 2 The additional costs incurred by DKS in undertaking this out of scope work are: Sub -consultant Billed to date Estimate to complete DKS Project Manager Administration CAD Total $1,608.35 $250.00 4hr @$120/hr $480.00 2hr @ $45/hr $90.00 2hr @ $65/hr $130.00 $2,558.35 In this case we have separately identified our administration staff time, rather than apply our standard 10% on -cost. Your approval is sought to increase our approved budget by $2,558.35. Once we receive your approval we will include this amount in our subsequent invoices. All other terms and conditions of the contract remain unchanged. Please sign, date and return this letter. Your signature will serve as confirmation of acceptance of the stated amount.
