A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL AUTHORIZING THE EXECUTION OF AN EASEMENT
DEED FOR AN UNDERGROUND ELECTRIC SERVICE FROM A
PG & E POLE ON CITY PROPERTY TO THE SONNEN
PROPERTY LINE.
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, PG & E is requesting an easement from the City of San
Rafael to provide electrical service to Sonnen BMW; and,
WHEREAS, the City is desirous of facilitating the completion of the
Sonnen BMW project; and,
WHEREAS, the granting of this easement is the most efficient way of
assisting PG & E in providing the required electrical service.
NOW, THEREFORE, BE IT RESOLVED the Council of the City of
San Rafael hereby authorizes the Mayor and City Clerk to execute a grant of easement to
PG & E for an underground electric service from a PG & E pole on City Property to the
Sonnen BMW property line.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on the 5°i day of April, 1999, by the following vote, to wit:

EASEMENT DEED
hereinafter called first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a
California corporation, hereinafter called second party, the right from time to time to construct,
reconstruct, install, inspect, maintain, replace, remove, and use facilities of the type hereinafter
specified, together with a right of way therefor, within a strip or parcel of land or along a route as
hereinafter set forth, and also ingress thereto and egress therefrom, over and across the lands situate
in the city of San Rafael , county of Marin , state of California, described as follows:

The parcel of land described and designated EXHIBIT D in the Final Order of Condemnation dated
December 11, 1973 and recorded in Book 2764 of Official Records at page 221, Marin County
Records.
Said facilities shall consist of:
Such underground conduits, pipes, manholes, service boxes, wires, cables, and electrical conductors;
aboveground marker posts, risers, and service pedestals; underground and aboveground switches, fuses,
terminals, and transformers with associated concrete pads; and fixtures and appurtenances necessary to
any and all thereof, as second party deems necessary located within the parcel of land described in
EXHIBIT "A" and depicted on EXHIBIT "B", attached hereto and made a part hereof.

PG&E EASEMENT - SONNEN BMW
A portion of that certain parcel of land described and designated "EXHIBIT D" in the Final Order of
Condemnation, dated December 11, 1973 and recorded in Book 2764 of Official Records, at page
221, Marin County Records, more particularly described as follows:
Beginning at a point on the southeasterly line of the hereinabove described parcel of land, which bears
North 50° 14'00" East, 62.04 feet from the intersection of the courses "South 390 46' 00" East 10.00
feet and North 50'14'00" East 625.47 feet" as described in said "EXHIBIT D";
thence leaving said southeasterly line North 39° 46' 00" West, 7.00 feet;
thence North 50' 14' 00" East, 10.00 feet;
thence South 39° 46' 00" East, 7.00 feet to a point on said southeasterly line;
thence along said southeasterly line South 50° 14' 00" West, 10.00 feet to the POINT OF
BEGINNING.
