RESOLUTION REJECTING ALL BIDS ON THE SECOND STREET
WIDENING AND LINDARO STREET RULE 20A UNDERGROUND UTILITY
PROJECT FOR NON-COMPLIANCE WITH SECTION 6.03 OF THE
CONTRACT DOCUMENTS AND DIRECT STAFF TO REBID THE PROJECT
WHEREAS, on the 27`h day of April, 1999, pursuant to due and legal notice
published in the manner provided by law, inviting sealed bids for proposals for the work
hereinafter mentioned, as more fully appears from the Affidavit of Publication thereof on
file in the office of the City Clerk of the City of San Rafael, California, the City Clerk of
said City did publicly open, examine, and declare all sealed bids or proposals for doing
the following work in said City, to wit:
"SECOND STREET WIDENING AND LINDARO STREET RULE 20A
UNDERGROUND UTILITY DISTRICT"
PROJECT NO. 048-4810-471-8000
in accordance with the plans and specifications therefore on file in the office of said City
Clerk; and
WHEREAS, staff have reviewed the two bids received for the project and
determined that both bidders have unbalanced their bids on a certain bid item, and
WHEREAS, City staff recommends to reject all bids for non-compliance with
Section 6.03 of the Contract Documents and rebid the project.
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that
the City Council of the City of San Rafael rejects all bids for subject project and directs
staff to rebid the project, and to return bidders bonds to each bidder.

BE IT FURTHER RESOLVED that the Director of Public Works take any and
all such actions and make changes as may be necessary to accomplish the purpose of this
resolution.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City held on the 3`d day of May, 1999, by the following
vote, to wit:
