Home My WebLink AboutCC Resolution 10422 (Marin Community College)RESOLUTION NO. 10422 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL MAKING FINDINGS REQUIRED BY HEALTH AND SAFETY CODE SECTION 33445, COMMITTING FUNDS FOR CONSTRUCTION OF CERTAIN SCHOOL FACILITIES AND TAKING RELATED ACTIONS (RE: MARIN COMMUNITY COLLEGE DISTRICT) WHEREAS, the City Council of the City of San Rafael (the "City Council") adopted the Redevelopment Plan f or the Central San Rafael Redevelopment Project Area (the "Redevelopment Plan") on November 20, 1972, by Ordinance No. 1079, as amended, affecting the Central San Rafael Redevelopment Project Area (the "Project Area"); and WHEREAS, the City Council adopted the Second Amended and Restated Redevelopment Plan for the Central San Rafael Redevelopment Project Area (the "Restated Redevelopment Plan") on October 5, 1998, by Ordinance No. 1732; and WHEREAS, the San Rafael Redevelopment Agency (the "Agency") is vested with responsibility pursuant to the Community Redevelopment Law (Part I of Division 24 of the Health and Safety Code of the State of California) (the "Law") to implement the Redevelopment Plan in the Project Area; and WHEREAS, the Marin Community College District (the "District") intends to improve certain school Facility as set forth in the attached Exhibit A (the "Facility") which are located within the Project Area or which serve Project Area residents; and WHEREAS, the Agency desires to expend funds for the construction of the Facility; and WHEREAS, construction of the Facility has been found to conform to the General Plan of the City; and WHEREAS, Agency expenditures for the Facility improve educational opportunities and provide expanded economic opportunities in the community, thus assisting in the redevelopment of the Project Area, all as more fully outlined in the Section 33679 Summary described below; and WHEREAS, a summary has been prepared and considered by the City Council, the Agency, and the District, and has been made available to the public as provided in Section 33679 of the Law (the "Section 33679 Summary"), which summary (1) estimates the amount of funds to be used by the Agency for the Facility, (2) sets forth facts supporting the findings made in this Resolution pursuant to Section 33445 of the Law, and (3) sets forth the redevelopment purpose to be served by the proposed Agency expenditure for the Facility; and i F� WHEREAS, on June 8, 1999 the District conducted a duly noticed public hearing pursuant to Section 33679 of the Law to obtain and consider public testimony regarding the expenditures proposed to be made by the Agency for the Facility; and WHEREAS, on June 21, 1999, the City Council and the Agency conducted a duly noticed public hearing pursuant to Section 33679 of the Law to obtain and consider public testimony regarding the expenditures proposed to be made by the Agency for the Facility; and WHEREAS, pursuant to Section 33445 of the Law, the Agency may, with the consent of the City Council, pay part or all of the installation of the Facility, if the City Council and the District make certain specified findings; and WHEREAS, the District made the required findings pursuant to Section 33445 of the Law by resolution adopted on June 8, 1999, following conduct of the District public hearing further described above; NOW, THEREFORE, IT IS HEREBY RESOLVED that based on information presented to the City Council, the Agency, and the District, including the information provided in the Section 33679 Summary, and in compliance with the requirements of Section 33445 of the Law, the City Council resolves that: 1. All of the above recitals are true and correct, and the City Council has based the findings and actions set forth in this Resolution, in part, on such recitals. 2. The City Council hereby finds and determines that: (a) development of the Facility will be of benefit to the Project Area; (b) no other reasonable method of financing the Facility is available to the community; (c) development of the Facility will assist in the elimination of one or more blighting conditions inside the Project Area; and (d) Agency assistance with the Facility is consistent with the Agency's current Implementation Plan. The factual and analytical basis used by the City Council in making these findings and determinations is set forth in the Section 33679 Summary and in the staff report and materials regarding the Facility provided to the City Council. 3. Subject to the conditions set forth in Paragraph 5 below, the City Council hereby consents to the expenditure of $270,203.05 for the purpose of District development of the Facility. 4. The Agency shall not expend any funds for the Facility unless and until the City, the District, and/or the Agency have completed all procedures and made all findings, in their sole and absolute discretion, required for such expenditure pursuant to the California Environmental Quality Act. 5. The attached Exhibit A is incorporated in to this Resolution by this reference. 6. This Resolution shall take immediate effect from and after its passage and approval. I, JEANNE M. Leoncim, City Clerk EXHIBIT A MARIN COMMUNITY COLLEGE DISTRICT PROJECT DESCRIPTION: DISTANCE LEARNING IN THE SAN RAFAEL REDEVELOPMENT PROJECT AREA The Marin Community College District has been a provider of innovative education using Distance Learning techniques since the mid-1970s, when televised courses were first offered. Now the College is using the latest technology tools like computer-assisted instruction, the Internet/World Wide Web, and videoteleconferencing, to provide greater access to education, information, and employment skills training to current and potential students. Agency funding will permit the District to bring these tools to the Project Area. The Distance Learning Facility in the Pickleweed Park Canal Learning Center will contain the following components, to be funded through the Agency: • several computers, with networked printer, for on-line library catalog and Internet research activities, MS Office Suite and CD Rom capabilities • several A/V stations for videotape and/or cable TV viewing • one studio -size compressed video unit for Distance Learning connections with the College of Marin's Kentfield and/or Indian Valley campuses, as well as other CoM Distance Learning locations • on and off site compressed video/network connection and system improvements as necessary • room and facility improvements The San Rafael High School Distance Learning -Equipped Classroom will contain one portable compressed video unit for Distance Learning connections with the College of Marin's Kentfield and/or Indian Valley campuses, as well as other CoM Distance Learning locations, to be funded through the Agency. These funds will cover on- and off-site compressed video/network connection and system improvements as necessary. The College/MEC Partnership's LEAP/CALL Distance Learning -Equipped Classroom and improvements to the Computer -Assisted Learning Lab (located at 2955 Kerner Blvd.) will contain the following components, to be funded through the Agency: • one portable compressed video unit for Distance Learning connections with the College of Marin's Kentfield and/or Indian Valley campuses, as well as other CoM Distance Learning locations • on- and off-site compressed video/network connection and system improvements included as necessary • upgrades to the existent computer lab, including English Language Learning and pre- vocational skills software for student/client use These Distance Learning facilities will enable the College to better serve the residents of the San Rafael Redevelopment Project Area by providing them with a variety of activities and programs. Likely examples of these include: • English as a Second Language classes • Welfare to Work programs (e.g., Childcare Worker classes) • Computer Literacy • Business Basics and "Foundation Skills" Classes • "Career Nights" • Community and College Forums • Education and Career Counseling Services (English and native language, as available) • Other programs and activities as appropriate to the College and the Area Marin Community College District Projects: Pickleweed Park Community Center $238,203.05 Distance Learning Center (Creation of Interactive Classroom), with on and off site compressed video/network and system improvements as necessary San Rafael High School $10,300.00 Distance Learning -Equipped Classroom, with on and off site compressed video/network and system improvements as necessary LEAP/CALL $21,700.00 Distance Learning Equipped Classroom and improvements to Computer Assisted Learning Lab, with on and off site compressed video/network and system improvements as necessary Total MCC District Projects: $270,203.05
