RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ACCEPTING GRANT DEED OF EASEMENT FOR THE CONSTRUCTION AND
MAINTENANCE OF STREET LIGHT FACILITIES - 150 PELICAN WAY.
(BAYVIEW BUSINESS PARK OWNERS ASSOCIATION)
WHEREAS, public interest, convenience and welfare require that the easement
hereinafter mentioned be accepted and used for the benefit of the public of the City of San
Rafael, California;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of San Rafael, California, that that certain grant deed of easement for the construction
and maintenance of street light facilities, executed by Bayview Business Park Owners
Association to the City of San Rafael, dated October 13, 1998, be and the same is hereby
accepted and the Clerk of said City is hereby directed to cause said conveyance to be duly
recorded in the office of the County Recorder of the County of Marin, State of California,
forthwith upon the adoption of this resolution.
I, JEANNE M. LEONCiNI, Clerk of the City of San Rafael, California, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City held on the 2"d. day of November, 1998, by the
following vote, to wit:

OF EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF STREET LIGHT FACILITIES
BAYVIEW BUSINESS PARK OWNERS ASSOCIATION (hereinafter called "Grantor" without regard to
number or gender) for an adequate consideration hereby GRANTS and conveys to the CITY OF SAN RAFAEL,
a municipal corporation, an EASEMENT over the strip of land hereinafter described for the purpose of
installing, constructing, renewing, inspecting, maintaining, repairing and using a street light and facilities on
said strip of land together with the right of ingress thereto and egress therefrom, in, on and across said strip of
land and the contiguous real property of Grantor.
Said strip of land is located in the City of San Rafael, County of Marin, State of California, and is more
particularly described as follows:

Grantor shall not plant, place or deposit anything in or on said strip of land which will damage or interfere with
any of the rights granted hereunder nor shall Grantor erect or construct any building or other structure or drill
or operate any well within said strip of land.
The provisions hereof shall inure to the benefit of and bind the heirs, successors, assigns of the respective parties
hereto.

Commencing at a City of San Rafael monument located along the centerline of
Pelican Way at the center of the cul-de-sac bulb as shown on that certain Parcel
Map, entitled "Parcel Map Bayview Business Park Unit 2, being a Resubdivision
of Parcel 4, Bayview Business Park (23 PM 99), San Rafael, Marin County,
California," filed for record April 23, 1991 in Volume 25 of Parcel Maps at Page
13, Marin County Records;
thence on a radial bearing S46°57'14" E 55.00 feet to a point on said Pelican Way
right of way, and being the True Point of Beginning;
thence S50°36'09" E 6.53 feet to a point;
thence N39° 16'19" E 7.00 feet to a point;
thence N 50°36'09" W 6.51 feet to a point on said Pelican Way right of way;
thence on a curve to the left, from a tangent which bears S 35044'55" W along said
Pelican Way right of way having a radius of 55.00 feet through a central angle of
70 17'51" for an arc length of 7.00 feet, to the True Point of Beginning.
