A RESOLUTION OF THE CITY COUNCIL OF CITY OF SAN RAFAEL
AUTHORIZING EXTENSION OF TIME FOR THE COMPLETION OF
IMPROVEMENT WORK - "BAYPOINT LAGOONS UNIT 2 SUBDIVISION"
(EXTENDED TO AND INCLUDING DECEMBER 19, 1999)
City Council,
Upon application of the Subdivider thereof, and due cause being shown this
IT IS HEREBY RESOLVED that the time within which the construction
of the improvement work provided for in that certain Agreement between the City of San
Rafael and Spinnaker Point Development Inc., as Subdivider, shall be completed, is hereby
extended to and includes the 19th. day of December, 1999. This extension shall not become
effective unless and until said Subdivider files with the City Clerk the written consent of
the Surety Company upon said Subdivider's Faithful Performance Bond to said
continuance and waiver of stature of limitations for the period of said extension.
I, Jeanne M. Leoncini, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the 7th. day of December, 1998, by the
following vote, to wit:
AYES: COUNCILMEMBERS: Cohen, Heller, Miller, Phillips & Mayor Boro
NOES: COUNCILMEMBERS: None

DEVELOPMENT, INC.
As you know, we have been unable to complete the landscaping improvements on Parcel
N due to the wicking operations. With the wicking now complete, we will finish the
improvements in Spring of 1999.
With this letter we are requesting the appropriate, or applicable, extension of the
Subdivision Agreement for Unit R of Baypoint Lagoons to accommodate completion of
this work.
