A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL AUTHORIZING A WAIVER OF BUILDING PERMIT FEES,
BUT NOT THE WAIVER OF TRAFFIC MITIGATION FEES FOR
BAYPOINT VILLAGE APARTMENTS;
(345 CATALINA ST.)
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, the San Rafael City Council establishes fees for the issuance of building
permits; and
WHEREAS, the City Council has received a request for a waiver of building permit
and traffic mitigation fees from Spinnaker Point Development, Inc. for the project
known as Baypoint Village Apartments; and
WHEREAS, Policy I:1-20 of General Plan 2000 encourages fee waivers for Below
Market Rate residential units; and
WHEREAS, Baypoint Village Apartments is a Below Market Rate development;
and
WHEREAS, City Council policy has been to approve the waiver of Building Permit
fees when requested, but to not waive traffic mitigation fees for Below Market Rate
Housing.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael
that for the development known as Baypoint Village Apartments that Building Permit fees
are waived and that the payment of traffic mitigation fees is required.

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing
resolution was duly and regularly introduced and adopted at a regular meeting of the Council of
said City on the 1st day of June, 1998, by the following vote, to wit:

NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Phillips
