A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
CERTIFYING THE NEGATIVE DECLARATION FOR EAST SAN RAFAEL
PROPOSED TRAFFIC OPERATIONAL IMPROVEMENTS
WHEREAS, on July 22, 1997, City Council held a study session to review
a traffic operational analysis of the Bellam Boulevard corridor and environs which
identified potential short-term and long-term solutions and recommended four (4)
ancillary traffic operation improvements and an interim solution to improve traffic flow
and increase capacity in the East San Rafael Area; and
WHEREAS, between October 8, 1997 and December 1, 1997 staff held 13
public workshops to discuss the four (4) ancillary traffic operation improvements and
interim solution and answer questions from the public; and
WHEREAS, an Initial Study and Negative Declaration were prepared by
staff which determined that the project would not create significant environmental
impacts; and
WHEREAS, the City provided a 30 -day public review period for the
Negative Declaration from December 19, 1997 to January 20, 1998, pursuant to the
requirements of CEQA; and
WHEREAS, on January 20, 1998, the San Rafael City Council held a duly
noticed Public Hearing on the project and the Negative Declaration, accepted public
testimony, accepted the written report of the Public Works Department staff and
determined the interim solution and ancillary traffic improvements will improve traffic
flow, decrease congestion and increase capacity in the East San Rafael Area; and
WHEREAS, the City Council exercised its independent judgment in
evaluating the Negative Declaration and determined that the Negative Declaration is
consistent with the provisions of CEQA in that: an Initial Study has been prepared on the
project which determined that there is no substantial evidence that the project will have a
significant impact on the environment; public notice of the intent to adopt the Negative
Declaration has been done pursuant to state law; and the Negative Declaration has been
considered in conjunction with comments received during the review period and the public
hearing.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
San Rafael that the Negative Declaration for the project has been completed in compliance
with CEQA and hereby adopts the document based on the finding that the project would
not create significant environmental impacts.
I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on the 20th day of January, 1998, by the following vote, to wit:
