HomeMy WebLinkAboutCC Resolution 10019 (Fair, Isaac & Co EIR)RESOLUTION NO. 10019 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE FAIR, ISAAC OFFICE PARK DEVELOPMENT The City Council of the City of San Rafael finds and determines that: WHEREAS, on March 31, 1997, the City of San Rafael (City) received applications from Village Properties, applicants, requesting an amendment to the PD District, Use Permit, Environmental and Design Review Permit and Tentative Map for the Fair, Isaac Office Park development, located on 15 acres fronting Second Street, Lindaro Street and Lincoln Avenue (AP 13-012-120 [ptn.], 13-021-100 and 13-021-190); and WHEREAS, the City, as lead agency for the preparation and consideration of environmental documents for said project, completed an Initial Study, consistent with the California Environmental Quality Act (CEQA). The Initial Study concluded that because the project had the potential to adversely effect the environment an Environmental Impact Report (EIR) would be required. A Notice of Preparation was distributed for a 30 -day public review, which included a public scoping hearing with the Planning Commission on April 29, 1997; and WHEREAS, the City has prepared a Draft Environmental Impact Report, Volume I - EIR Text and Appendices, dated August 18, 1997 (DEIR). The City observed a 45 -day period for public review of the document, which included a public hearing held by the Planning Commission on September 23, 1997; and WHEREAS, the City has evaluated the comments received by public agencies, organizations and persons who reviewed the DEIR and has prepared responses to comments received during the 45 -day public review period; and WHEREAS, said comments and recommendations received on the DEIR, either verbatim or in summary, a list of agencies, organizations and persons commenting on the DEIR, and the responses of the City have been attached to and made a part of the DEIR (Volume II, Response to Comments, December 1, 1997) and a "Modifications to the Fair, Isaac Office Park FEIR (December 23, 1997) to form the Final Environmental Impact Report (FEIR) for said project, as required by Section 15132 of the State CEQA Guidelines. In addition, a Mitigation Monitoring and Reporting Program has been prepared to outline procedures for implementing all mitigation measures in the FEIR; and WHEREAS, the City desires and intends to use the FEIR for the Fair, Isaac Office Park project as the environmental documentation required by CEQA and the State Guidelines for each of the above -referenced discretionary actions to the extent authorized by the law. nR.� U Inn to WHEREAS, on January 7, 1998, the Planning Commission accepted public testimony on the Volume II, Response to Comments and the Modifications to the Fair, Isaac Office Park FEIR. Following closure of the public hearing, responses to comments on the FEIR/Response to Comments document were read into the record by staff and the EIR consultant. The Planning Commission, on a 6-0-1 vote, adopted Resolution 98-1 recommending to the City Council certification of the Final Environmental Impact Report. WHEREAS, on February 9, 1998, the City Council accepted public testimony on the Volume II, Response to Comments and the Modifications to the Fair, Isaac Office Park FEIR. As part of the hearing and review, the City council considered the agenda report, dated February 9, 1998, which includes several amendments to the FEIR. WHEREAS, the City Council has reviewed the Final Environmental Impact Report for the project in its entirety, as well as all staff and Planning Commission reports related to the environmental review of the project, and all evidence received by the Planning Commission at the duly noticed public hearings regarding the project, all of which are hereby incorporated by reference into this Resolution. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council finds that the Final Environmental Impact Report for the Fair, Isaac Office Park development has been prepared in accordance with the required CEQA and the State Guidelines and hereby certifies the document. I, JEANNE M.
