HomeMy WebLinkAboutCC Resolution 9984 (Bedroom Noise)RESOLUTION # 9 9 8 4 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING GENERAL PLAN TEXT AMENDMENT TO AMEND NOISE ELEMENT POLICY N-7 TO INCREASE THE ALLOWED DECIBELS FOR BEDROOMS FROM 40 dB Ldn (DECIBELS AND SOUND LEVEL AT DAY -NIGHT AVERAGE) TO 45 dB Ldn FOR NEW MULTIFAMILY RESIDENTIAL DEVELOPMENTS IN THE DOWNTOWN AREA; City of San Rafael WHEREAS, on October 3, 1997, the City of San Rafael's Community Development Department initiated an amendment to General Plan Noise Element policy N-7 to increase the allowed decibels for bedrooms from 40 dB Ldn (decibels and sound level at day -night average) to 45 dB Ldn for new multi -family residential developments; and, WHEREAS, on October 14, 1997, the San Rafael Planning Commission held a duly noticed Public Hearing on the proposed General Plan Amendment (GPA 97-3) and continued the item; and WHEREAS, on October 28, 1997, the San Rafael Planning Commission held a duly noticed Public Hearing on the proposed General Plan Amendment (GPA 97-3) accepting public testimony and the written report of the Planning Department staff and continued the item; and WHEREAS, on November 6, 1997, the San Rafael Planning Commission held a duly noticed Public Hearing on the proposed General Plan Amendment (GPA 97-3) accepting public testimony and the written reports of the Planning Department staff; and WHEREAS, the Planning Commission has recommended adoption of the proposed General Plan Amendment; and WHEREAS, on November 17, 1997, the San Rafael City Council held a duly noticed Public Hearing on the proposed General Plan Amendment, accepting public testimony and the written reports of the Planning Department staff, NOW THEREFORE BE IT RESOLVED, that the City Council of the City of San Rafael hereby approves General Plan Amendment GPA 97-3, as shown on Exhibit A, based on the following finding; 1. The proposed General Plan Amendment to amend Noise Element Policy N-7 to increase the allowed noise decibels for bedrooms for new multifamily residential developments in Downtown from 40 dB Ldn (decibels and sound level at day -night average) to 45 dB Ldn, consistent with State of California Administrative Code Requirements, serves the public interest in that it is consistent with General Plan policies that encourage construction of affordable housing projects in the City, particularly in the Downtown area. -1- y ! kaae I, JEANNE M. LEONCI I, City Clerk 2 -2- EXHIBIT A `To protect against exterior noise sources, the following interior standards shall apply: • For new single-family, single-family with second dwelling unit and residential health care development and multifamily (development containing two or more units, but excluding second dwelling units) residential development outside of Downtown, the standard shall be 40dB Ldn for bedrooms and 45 dB Ldn for other rooms. • For hotels, motels and Downtown multifamily residential development, the standard shall be 45 dB Ldn. Sound transmission between units shall be as described by State Administrative Code Title 25, Part 2."
