A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL GRANTING A WAIVER OF BUILDING AND PLANNING
FEES AND DENYING A WAIVER OF TRAFFIC MITIGATION
FEES FOR FOUR B.M.R. UNITS LOCATED AT BAYPOINT
LAGOONS (LOTS 94, 95, 96, AND 97).
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, Spinnaker Point Development, Inc. has requested a waiver of
building and planning permit application fees and a waiver of traffic mitigation fees for
four below market rate units at the Baypoint Lagoons Development (Lots 94, 95, 96, and
97); and
WHEREAS, the Housing Element of the City of San Rafael General Plan
providc4that permit application fees for projects affordable to low or moderate income
persons may be waived; and
WHEREAS, the four below market rate units at Baypoint Lagoons are
subject to a Below Market Rate Housing Agreement between the City of San Rafael, the
Housing Authority of the County of Marin, and Spinnaker Point Development, Inc.; and
WHEREAS, the City Council of the City of San Rafael has not waived
traffic mitigation fees in the past; and
WHEREAS, payment of traffic mitigation fees is a specific condition of
the approval of this subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
San Rafael that in view of the foregoing findings, the request for a waiver of building and
planning permit fees i s granted and the request for a waiver of traffic mitigation fees is
not granted for four BMR units at Baypoint Lagoons.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on the 21" day of April, 1997, by the following vote, to wit:
