HomeMy WebLinkAboutCC Resolution 9843 (Del Ganado Maintenance Assessment)RESOLUTION NO. 9843 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL, CALIFORNIA, INITIATING PROCEEDINGS FOR THE FORMATION OF THE SAN RAFAEL DEL GANADO MAINTENANCE ASSESSMENT DISTRICT 97-2, AND THE LEVY AND COLLECTION OF ASSESSMENTS FOR FISCAL YEAR 1997/981 PURSUANT TO THE PROVISIONS OF PART 2 OF DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE The City Council of the City of San Rafael (hereafter referred to as City Council') Hereby Finds, Determines, Resolves and Orders as Follows: Section 1 The City Council desires to initiate proceedings for the formation of the San Rafael Del Ganado Maintenance Assessment District 97-2 (hereafter referred to as the "District") within the territory described in Section 2 of this Resolution, pursuant to provisions of the Landscape and Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with section 22500) (hereafter referred to as the "Act"), pursuant to Article 1 of Chapter 2 of the Act; that provides for the formation of an assessment district to pay the cost and expenses of the improvements described in Section 3, hereof. Section 2 The territory proposed to be included within the District boundary is generally described as follows: The territory of the proposed District is within the boundaries of the City of San Rafael, within the County of Marin, State of California and includes 740 parcels totaling approximately 222 acres. The territory of the proposed District includes the residential subdivisions known as the Santa Margarita Neighborhood Association and lies generally within the assessment district boundary map attached to this resolution. Section 3 The proposed improvements for the District are briefly described as the installation, operation, maintenance and servicing of landscape improvements along Del Ganado Road. The specific areas of improvement includes all landscape amenities along the Del Ganado ditch. The improvements include all necessary service, operations, administration and maintenance required to keep the �IIAG4P��lae°' improvements in a healthy, vigorous, and satisfactory condition and may include but are not limited to: landscaping within the public right-of-ways including the installation, cultivation, replacement and maintenance of planting material such as turf, ground cover, shrubs, and trees; maintenance and repair of landscape irrigation and drainage systems and other appurtenant facilities permitted under the Act. Section 4 The City Council hereby orders the Engineer, MuniFinancial, to prepare and file with the City Clerk a report in writing in connection with the formation of the District for the fiscal year commencing July 1, 1997 and ending June 30, 1998. The report shall be prepared in accordance with Article 4 of Chapter 1 of the Act. I, JEANNE M.
