A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL RESCINDING RESOLUTION NO. 9767
WHEREAS, on January 6, 1997, the City Council of the City of San Rafael adopted
Resolution No. 9767, awarding a contract for a First and C Street drainage improvement project
to Maggiora & Ghilotti, Inc.; and
WHEREAS, the awarding of the aforementioned contract by the City Council was
erroneous since the aforementioned drainage improvement project is being undertaken and
filnded by the San Rafael Redevelopment Agency rather than the City of San Rafael; and
WHEREAS, the San Rafael Redevelopment Agency has today awarded a contract for
the First and C Street drainage project to Maggiora & Ghilotti, Inc.
NOW THEREFORE BE IT RESOLVED that Resolution No. 9767 is rescinded ab
initio, and is declared void and of no force and effect.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that this
resolution was duly and regularly introduced and adopted at a regular meeting of said City
Council held on the 21" day of January, 1997, by the following vote, to wit:
AYES: COUNCILMEMBERS: Heller, Miller, Phillips & Vice -Mayor Cohen
NOES: COUNCILMEMBERS: None.
ABSENT: COUNCILMEMBERS: Mayor Boro
