RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AWARDING
THE CONTRACT FOR FIRST AND "C" STREET DRAINAGE IMPROVEMENTS TO
MAGGIORA & GHILOTTI, INC. IN THE AMOUNT OF $147,741.00 2VNB *-'FH04HZ-ING-

WHEREAS, on the 19" day of November, 1996, pursuant to due and legal notice
published in the manner provided by law, inviting sealed bids or proposals for the work hereinafter
mentioned, as more fully appears from the Affidavit of Publication thereof on file in the office of the
City Clerk of the City of San Rafael, California, the City Clerk of said City did publicly open,
examine, and declare all sealed bids or proposals for doing the following work in said City, to wit:
"FIRST AND "C" STREET DRAINAGE IMPROVEMENT"
PROJECT NO. 916-9016-8770
in accordance with the plans and specifications therefore on file in the office of said City Clerk; and
said work; and
WHEREAS, the bid of Bauman Landscape, Inc. was the original low bidder for
WHEREAS, on the 30'hof the December, 1996, Bauman Landscape, Inc. withdrew
their bid following the expiration of the 30 day time period; and
WHEREAS, on the 30`h of the December, 1996, Maggiora & Ghilotti, Inc., the
second low responsible bidder, confirmed to hold the bid at the unit prices stated in its bid for said
work.
NOW, THEREFORE, BE IT RESOLVED that the bid of Bauman Landscape,
Inc., is hereby accepted as withdrawn from said work without penalty; and
IT IS FURTHER RESOLVED that the bid of Maggiora & Ghilotti, Inc., is hereby
accepted at said unit prices and that the contract for said work and improvements be and the same is
hereby awarded to said Maggiora & Ghilotti, Inc. at the unit prices mentioned in said bid.
IT IS FURTHER RESOLVED that the Mayor and the City Clerk of said City of San
Rafael be authorized and directed to execute a contract with Maggiora & Ghilotti, Inc. for said work
and to return the bidders bond upon the execution of said contract; and
IT IS FURTHER RESOLVED that the Director of Public Works is authorized to
take any and all such actions and make changes as may be necessary to accomplish the purpose of this
resolution; and

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the
Council of said City on Monday, the 6th day of January, 1997, by the following vote, to wit:
