HomeMy WebLinkAboutCC Resolution 9737 (Code Enforcement Program)RESOLUTION 9 7 3 7 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DIRECTING DEVELOPMENT AND IMPLEMENTATION OF A COMPREHENSIVE CODE ENFORCEMENT PROGRAM WHEREAS, the code enforcement program is not able to meet service demands due to limited staff; and, WHEREAS, the Municipal code does not clearly establish the enforcement authority and responsibilities of the code Enforcement Officer and other enforcement staff; and, WHEREAS, cost effective alternative enforcement remedies are needed in addition to the available administrative abatement procedures and the courts; and, WHEREAS, a dedicated revenue stream is necessary to assure the availability of adequate code enforcement services in the Planning and law Departments; and, WHEREAS, the Planning Department has recommended a strategy of actions to establish a comprehensive code enforcement program; NOW, THEREFORE, BE IT RESOLVED,. that the City Council hereby directs the following actions to begin implementation of the program: 1) Direct the City Attorney to prepare a Code Enforcement Enabling Ordinance. 2) Direct the City Attorney to provide for a Hearing Officer in the Enabling Ordinance 3) Direct the Personnel Director to update the Code Enforcement Officer job description and begin recruitment 4) Direct the Personnel Director to recruit two Asst. Code Enforcement Officers 5) Direct the City Attorney to recruit a Hearing Officer 6) Direct the Planning Director to apply for Community Development Block Grant Funds to partially underwrite the Canal Code Enforcement Program 7) Direct the Administrative Services Director to amend the FY96-97 budget to fund the Comprehensive Code enforcement Program including an allocation of $55,000 of Federal COPS funds. 8) Direct the Police Chief to prepare the appropriate resolution for use of the Federal COPS grant funds for the start up of this program.
