HomeMy WebLinkAboutCC Resolution 9730 (Household Hazardous Waste Fee)RESOLUTION NO. 9 7 3 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL SETTING A HOUSEHOLD HAZARDOUS WASTE REGULATORY FEE, AND A CONDITIONALLY EXEMPT SMALL QUANTITY GENERATOR REGULATORY FEE, PURSUANT TO CHAPTERS 9.22 AND 9.23 OF THE SAN RAFAEL MUNICIPAL CODE WHEREAS, the City Council of the City of San Rafael on May 20, 1996 adopted Ordinance No. 1696 amending the San Rafael Municipal Code (SRMC), to add (1) Chapter 9.22, Regulatory Fees for Household Hazardous Waste Activities, establishing a Household Hazardous Waste Regulatory Fee to be set by City Council Resolution, and (2) Chapter 9.23, Regulatory Fees for Conditionally Exempt Small Quantity Generator Waste Activities, establishing a Small Quantity Generator Regulatory Fee to be set by City Council Resolution; and WHEREAS, the purpose and intent of the Household Hazardous Waste Regulatory Fee is to ensure, in part, the future health, safety and general welfare of the City's citizens by establishing a funding source to pay for the operating expenses of the City's household hazardous waste facility for receipt and disposition of household hazardous waste generated by households located within the City; and WHEREAS, the purpose and intent of the Small Quantity Generator Regulatory Fee is to ensure, in part, the future health, safety and general welfare of the City's citizens by establishing a funding source to pay for the operating expenses of the City's conditionally exempt small quantity generator waste collection facility for receipt and disposition of so-called small quantity generator waste generated and brought to the facility by commercial sources; and WHEREAS, SRMC Section 9.22.030 authorizes the City Council of the City of San Rafael to periodically set by Resolution the rates for the Household Hazardous Waste Regulatory Fee, which will be paid by every person, corporation or other entity owning or occupying residential premises within the City, in accordance with the approved budget for operating expense and closure costs for the City household hazardous waste collection program; and WHEREAS, SRMC Section 9.23.030 authorizes the City Council of the City of San Rafael to periodically set by Resolution the rates for the Conditionally Exempt Small Quantity Generator Regulatory Fee, which will be paid by every person, corporation or other entity which generates and brings conditionally exempt small quantity generator waste to the City's collection facility, in accordance with the approved budget for operating expense and closure costs for the City conditionally exempt small quantity generator collection program; and WHEREAS, the City Council of the City of San Rafael on October 21, 1996 held a public hearing to review and received public comment on the proposed Household Hazardous Waste Regulatory Fee and Conditionally Exempt Small Quantity Generator Regulatory Fee; and WHEREAS, the City Council at the public hearing reviewed the staff report prepared by the Fire Department containing the proposed budgets for the household hazardous waste collection program and the conditionally exempt small quantity generator collection program, and the proposed Household Hazardous Waste Collection Fee and Conditionally Exempt Small Quantity Generator Fee; and WHEREAS, the City Council finds that the health, safety and general welfare of the City's citizens require the funding of the City's household hazardous waste collection program and conditionally exempt small quantity generator program. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael approves the proposed budgets for the household hazardous waste collection program and conditionally exempt small quantity generator program, and sets the rates for the Household Hazardous Waste Regulatory Fee as set forth in Exhibit "A" hereto, and the Conditionally Exempt Small Quantity Generator Regulatory Fee, as set forth in Exhibit `B" hereto, to remain in effect hereafter until amended, suspended, or rescinded by Resolution of the City Council. BE IT FURTHER RESOLVED that the City Council of the City of San Rafael finds that the actions taken by this Resolution are not subject to the California Environmental Quality Act (CEQA), pursuant to Article 5, Section 15061(b)(3) of the CEQA Guidelines because there is no possibility that they will have a significant effect on the environment as provided in CEQA. The City Clerk is hereby directed to file the necessary Notice of Exemption as provided under CEQA. I, JEANNE M. LEONC$TI, City Clerk (Revised 10-8-96) EXHIBIT A HOUSEHOLD HAZARDOUS WASTE FEE The household's (unit) apportioned share of the annual costs of the Household Hazardous Waste Program shall be calculated as follows: Annual Cost divided by total number of households in the City, Jurisdiction and other political subdivisions participating in the Household Hazardous Waste Program. $395,788 _ 33,611 = $11.78/unit/vear The annual cost will be based upon the fiscal year budget approved by the City Council of the City of San Rafael, as may be modified from time to time for the HHWP to serve the projected number of households to be served in the City and in other participating jurisdictions and shall include the projected annual cost for collection, storage, treatment, recycling, transportation and disposal of household hazardous waste, City administrative costs and the related cost for a fund to cover facility closure. One-fourth of the jurisdiction's apportioned share of such annual costs shall be due and payable to the City or company quarterly plus thirty days beginning July 1 of each year. If the jurisdiction terminates the agreement before the end of a fiscal year, the Jurisdiction will continue to be responsible for its apportioned share of the annual costs for the entire year. Should a special situation arise that warrants other pricing, the Agency will be notified and informed an the situation. All fees are costs for labor, storage, transportation, treatment and disposal. An additional amount of 10 percent shall be added to each of the events to cover City administrative costs and the related cost for the required fund to cover facility closure. Fees for CESQG shall be collected at the time of service by the Company or may be invoiced if authorized by Company. All regulatory fees collected by Company as set forth in this exhibit shall be paid to the City of San Rafael quarterly plus 30 days beginning July 1 of each year.
