A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
INCREASING THE CURRENT $15 RATE PER RUNOFF UNIT TO $20 FOR 1996 AND
THEREAFTER INCREASING IT BY $2 PER YEAR FOR THE FOLLOWING FOUR (4)
YEARS, TO A MAXIMUM OF $28 PER YEAR, FOR PURPOSES OF CALCULATING
THE CLEAN STORMWATER ACTIVITY FEE PURSUANT TO CHAPTER 9.40 OF
THE SAN RAFAEL MUNICIPAL CODE (SRMC).
WHEREAS, the City Council of the City of San Rafael on June 19, 1995
adopted Ordinance No. 1680 creating Chapter 9.40, Regulatory Fee for Clean Storm
Water Activities of the San Rafael Municipal Code (SRMC) and establishing a Clean
Stormwater Activity Fee; and
WHEREAS, the purpose and intent of the Clean Stormwater Activity Fee
is to ensure, in part, the future health, safety and general welfare of the citizens of the city
by establishing a funding source to provide maintenance and repair of the city's storm
drainage facilities, to provide capital improvements to the city's storm drainage system,
and to provide other clean stormwater activities; and
WHEREAS, Section 9.40.050, Subsection 4, authorizes the City Council
of the City of San Rafael to set by Resolution a rate per runoff unit for purposes of
calculating the Clean Stormwater Activity Fee and to adjust said rate from time to time;
and
WHEREAS, the City Council of the City of San Rafael on July 17, 1995
adopted Resolution No. 9420 establishing a rate per runoff unit of $15; and
WHEREAS, the City Council of the City of San Rafael on August 5, 1996
held a public hearing to review the rate per runoff unit for purposes of calculating the
Clean Stormwater Activity Fee; and
WHEREAS, the City Council at said public hearing reviewed the analysis
prepared by the Public Works Department entitled "City of San Rafael - Proposed Capital
Improvement Program - Storm Drainage Needs" which indicates that there are
$16,612,000 in unfunded drainage improvement projects throughout the City of San
Rafael; and
WHEREAS, the City Council of the City of San Rafael on May 6, 1996
adopted Resolution No. 9607 accepting the findings of the Public Works Department
Study entitled "San Rafael Storm Water Pump Station Project 1995-1996 - Modernization

and Renovation" and adopted a ten (10) year implementation schedule for required
improvements at an estimated cost of $1,905,000; and
WHEREAS, the City Council of the City of San Rafael wishes to ensure
the future health, safety and general welfare of the citizens of the city and to protect and
enhance the water quality of the state's and nation's watercourses in a manner pursuant to
and consistent with the Clean Water Act and the Basin Urban Runoff Plan; and
WHEREAS, the City Council finds that the enhancement and protection of
the water quality of the state's and nation's watercourses, consistent with the Clean Water
Act and the Basin Urban Runoff Plan, requires the City to undertake as promptly as
reasonably possible to replace, repair and improve the drainage infrastructure as specified
herein and to do so requires additional funding as specified in the accompanying staff
report.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Rafael finds that the proposed increase in the Rate per Runoff Unit is not subject to the
California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061(b)(3) of the
CEQA Guidelines because there is no possibility that the proposed increase may have a
significant effect on the environment. The City Clerk is hereby directed to file the necessary
Notice of Exemption.
IT IS FURTHERMORE RESOLVED that the repair of the city's storm
drainage facilities and capital improvements to the city's storm drainage system will
reduce the potential for erosion, turbidity at the storm water pump stations, and discharge
of pollutants such as sedimentation into the Bay.
IT IS FURTHERMORE RESOLVED that these improvements ensure
the future health, safety and general welfare of the citizens of the city by protecting and
enhancing the water quality of the state's and nation's watercourses in a manner pursuant
to and consistent with the Clean Water Act.
IT IS FURTHERMORE RESOLVED that for purposes of calculating
the Clean Stormwater Activity Fee, that rate per runoff unit shall be increased as follows:
