Resolution authorizing a Letter of Intent to the Dixie School District to Purchase 2.8
acres known as the Bernard Hoffman Ballfields.
WHEREAS, The Dixie School District has notified the City of their intent to sell a
parcel of surplus school property known as the Bernard Hoffman ballfields; and,
WHEREAS, the State of California Education Code 39390 was enacted in 1980
for the purpose of preserving for continued public use, certain playground, playing
fields and recreational real property which was declared by school districts to be
surplus; and,
WHEREAS, The legislation is designed to provide local public agencies a "right
of first refusal" to purchase surplus school playing fields, and to ensure local public
agencies a reasonable and affordable sales price; and,
WHEREAS, The City must, within 60 days of receipt of the districts notice to sell,
no later than August 11, 1996 inform the district, in writing, of its intention to purchase
the site; and,
WHEREAS, the Recreation Element of the City's General Plan, adopted in 1986,
identifies the Bernard Hoffman 2.8 acres of ballfields as high priority and one of the sites
the City would purchase if declared surplus; and,
WHEREAS, the Park and Recreation Commission reviewed the legal facts,
General Plan policies and community comments and recommends the City Council
recognize the need in the community and initiate a "Letter of Intent" to the Dixie District;
and,
WHEREAS, the City Council hereby finds because there are no comparable
facilities in the Terra Linda Valley for girls softball, no neighborhood park facilities in
the immediate area of the school site and there is a very high interest in the community
to preserve this facility the Council hereby determines that public lands in the vicinity of
the school site are inadequate to meet the existing or foreseeable needs of the community
for public playgrounds, playing fields and other outdoor recreation sites.
Now, therefore, be it resolved that the City Council of the City of San
Rafael does hereby authorize the Recreation Director to send the Dixie School
District a Letter of Intent to purchase 2.8 acres known as the Bernard Hoffman
Ballfields.

Dear Caryl,
As per procedure outlined in the State Education Code Section 39390 the following
notice is forwarded to the Dixie School District.
Notice of Intent to Purchase Surplus Playing Fields
(Bernard Hoffman Field) under Education Code section 39390
(the Naylor Act)
Upon adoption by the San Rafael City Council at its meeting of August 5, 1996 of a
Resolution authorizing this letter and making a finding of necessity the City of San
Rafael hereby notifies the Dixie School District of the City's intention to purchase the
Bernard Hoffman Field, a property declared to be surplus by the District in its letter
"sent" June 12,1996. A copy of that Resolution is attached for your information.
Under the Naylor Act, with this letter of intent, the City initiates the process of
negotiating a contract with the District for the purchase of Bernard Hoffman Field.

and schedule the negotiation process.
