RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ACCEPTING GRANT DEED FOR PORTION OF DEER VALLEY ROAD
RIGHT OF WAY FROM TCR #412 DEER VALLEY LIMITED PARTNERSHIP,
DEER VALLEY APARTMENTS (FORMERLY KNOWN AS OAKRIDGE
APARTMENTS).
WHEREAS, the public interest, convenience, necessity and welfare require
that the real property hereinafter mentioned be accepted and us&or the benefit of the
public of the City of San Rafael, California; and
WHEREAS, improvements in right of way for that portion of Deer Valley
Road are completed.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael, California, does hereby accept that certain deed from TCR #412 Deer
Valley Limited Partnership, a Texas limited partnership dated June 4, 1996, for and on
behalf of the City of San Rafael and the real property described herein, all as more
particularly described and set forth in Exhibit "A" attached hereto and incorporated
herein by reference, and the Clerk of the said City is hereby directed to cause said deed to
be duly recorded in the Office of the County Recorder of the county of Marin, State of
California, forthwith upon the adoption of this resolution.
IT IS FURTHER RESOLVED that the City Council of the City of San
Rafael hereby directs the City Engineer to release the Performance Bond and proceed
with the filing of a Notice of Completion for the right of way improvements.
IT IS FURTHER RESOLVED that the City Council of the City of San
Rafael direct the City Engineer to release the Labor & Material Bond ninety (90) days
after the release of the Performance Bond.

hereby certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the Council of the said City held on the 19" day of
August, 1996, by the following vote, to wit:
