RESOLUTION AMENDING RESOLUTION #9574,
ACCEPTING GRANT DEED FOR PORTION OF RICE
DRIVE'S RIGHT OF WAY FROM ROLAND A. BACCI
AND BEVERLY A. BACCI, TRUSTEES, OR SUCCESSOR
TRUSTEE(S) UNDER THE ROLAND AND BEVERLY
BACCI FAMILY TRUST U/A/D/4/19/90 AS AMENDED—
PARCEL MAP FOR LANDS OF BACCI (S94-11).
WHEREAS, the public interest, convenience, necessity and welfare require
that the real property hereinafter mentioned be accepted and usclfor the benefit of the
public of the City of San Rafael, California; and
WHEREAS, the same grant deed was presented and accepted by the City
Council on April 1, 1996, under Resolution #9574; and
WHEREAS, corrections (deletion of assessor parcel numbers not
associated with the right of way) were made to the original grant deed, and on the advice
from the City Attorney's office, the City requested Mr. & Mrs. Roland Bacci to resubmit
a new grant deed;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael, California, does hereby accept that certain new grant deed from
Roland A. Bacci and Beverly A. Bacci, Trustees, or Successor Trustee(s) under the
Roland and Beverly Bacci Family Trust U/A/D 4/19/90 as amended dated May 8, 1996,
for and on behalf of the City of San Rafael and the real property described herein, all as
more particularly described and set forth in Exhibit "A" attached hereto and incorporated
herein by reference, and the Clerk of the said City is hereby directed to cause said deed to
be duly recorded in the Office of the County Recorder of the county of Marin, State of
California, forthwith upon the adoption of this resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California,
hereby certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the Council of the said City held on the 19`h day of
August, 1996, by the following vote, to wit:

Beginning at a 3/4" iron pipe with plastic cap "LS 5814" marking the intersection of the
southerly line of the parcel conveyed to Bacci by Document Number 84-087055, Marin
County Records, with the easterly line of Rice Drive; thence along the easterly line of
Rice Drive, N 36052'30" E, 76.89 feet; thence N 40023'40" W, 61.51 feet to the westerly
line of Rice Drive; Thence along said line S 36052'30" W, 76.89 feet; Thence
S 40023'40" W, 61.51 feet to the point of beginning.
