HomeMy WebLinkAboutCC Resolution 9685 (Underground Utility District)A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING RESOLUTION NO. 9431 ESTABLISHING UNDERGROUND UTILITY DISTRICT IN THE VICINITY OF "A" STREET, SECOND AND THIRD STREETS WHEREAS, Resolution No. 9431 of the City Council of the City of San Rafael declared an Underground Utility District, designated as "Underground Utility District in the vicinity of "A" Street, Second and Third Streets" on the 7"' day of August, 1995; and WHEREAS, said Resolution No. 9431 fixed June 1, 1996 as the date on which affected property owners within the Underground Utility District must be ready to receive underground service, and ordered the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within said Underground Utility District on or before December 1, 1996; and WHEREAS, the original project schedule since August 7"', 1995, has been updated to accommodate longer than expected design and construction times; and WHEREAS, the revised project schedule will allow for an extension of time for affected property owners within the Underground Utility District to prepare to receive underground service, and shall set back the date by which the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within said Underground Utility District are to be completed. NOW THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael; that the Council does hereby fix February 17, 1997 as the extended date on which affected property owners must be ready to receive underground services; and does hereby fix March 31, 1999 as the revised date by which the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within said Underground Utility District must be completed. -7- & O$ �r r, r RESOLVED, FURTHER, that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within said Underground Utility District of the adoption of this resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution to affected Property owners such as are shown on the last equalized assessment roll and to the affected utilities. I, JEANNE M.
