A Resolution of the San Rafael City Council
terminating the Hazardous and Solid
Waste Management Joint Powers Agreement
WHEREAS, the Marin Cities and Towns and the County of Marin
entered into the Hazardous and Solid Waste Joint Powers Agreement
in 1993; and
WHEREAS, a restructured Hazardous and Solid Waste Joint Powers
Authority has been drafted and member agencies have agreed to
terminate the present Joint Powers Authority; and
WHEREAS, the City of San Rafael wishes to exercise its right
to withdraw from the Authority, effective June 30, 1996, under
Article 14 of the Agreement; and
NOW, THEREFORE BE IT RESOLVED, that the San Rafael City
Council hereby withdraws from the Hazardous and Solid Waste Joint
Powers Authority effective June 30, 1996, as provided under Article
14 of the Agreement; and
BE IT FURTHER RESOLVED, that Authority funds, remaining upon
termination of the Authority and after payment of all obligations,
shall be transferred to any successor regional Authority under
Article 9, Section 9.4.a Disposition of Authority Funds Upon
Termination; and
BE IT FURTHER RESOLVED, that the San Rafael City Council finds
that this action of withdrawal, combined with the actions of the
other Cities and Towns and the County effectively terminates the
existing Hazardous and Solid Waste Joint Powers Agreement as
provided in Article 12 of that agreement.

certify that the foregoing resolution was duly and regularly
introduced and adopted at a REGULAR meeting of the City
Council of said City held on MONDAY, the 15th
day of APRIL , 1996 by the following vote, to wit:

NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: None
DISQUALIFIED: COUNCILMEMBERS: Zappetini (due to conflict of interest)
