RESOLUTON OF THE SAN RAFAEL CITY COUNCIL
WAIVING PAYMENT OF FEES FOR THE LINCOLN AVENUE APARTMENT
PROJECT
WHEREAS, Policy H-20 of the Housing Element of the City of San Rafael General
Plan 2000 provides fees shall be waived or reduced for projects which
provide more than fifteen percent of total units affordable to low
income (50-80% of median) and moderate income (80-100% of median)
households with at least eight percent for low income households for 40
years: and,
WHEREAS, the San Rafael Planning Commission did on April 12, 1995, approve an
Environmental and Design Review Permit for a seven -unit apartment
project known as Lincoln Avenue Apartments located at 1349 Lincoln
Avenue; and,
WHEREAS, the Lincoln Avenue Apartments have been funded by a U.S department
of Housing and Urban Development Section 811 loan which requires
that the units be affordable to low income persons for forty years; and
WHEREAS, six of the seven units will be occupied by persons who will be restricted
by their disabilities from driving;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael that
the requirement for payment of all Planning and Building Permit
application fees is hereby waived, except that the applicant shall be
required to pay the fee for one (1) peak PM traffic trip; and
BE IT FURTHER RESOLVED, that any fees which have been paid to date shall be
refunded to the applicant.

foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the City Council of said City held on MONDAY , the 2nd day of
OCTOBER , 1995, by the following vote, to wit:
