HomeMy WebLinkAboutCC Resolution 9489 (General Plan Amendment)RESOLUTION NO.9 4 8 g RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING A NEGATIVE DECLARATION AND ADOPTING GENERAL PLAN AMENDMENT GPA95-2 AND ZONE CHANGES ZC95-4 WHEREAS, City planning staff periodically proposes miscellaneous "cleanup" amendments as a result of periodic General Plan evaluation and in response to projects; and, WHEREAS, notification of the proposed GPA95-2 amendment package and ZC95-4 zone change occurred as specified by State law; and, WHEREAS, an environmental assessment for the proposed amendments and zone changes resulted in a Negative Declaration of Environmental Impacts. The Negative Declaration was prepared by September 28, 1995 and was posted with the County Clerk's Office on September 29, 1995; and, WHEREAS, the San Rafael Planning Commission is required by State law to hold at least one public hearing and make a written recommendation to the legislative body on the adoption of any Plan amendments and zone changes; and, WHEREAS, the San Rafael Planning Commission held a public hearing on October 24, 1995, to hear public comments on the proposed amendments and Negative Declaration; and WHEREAS, the Planning Commission reviewed the staff report and written and verbal testimony on the Negative Declaration and the proposed General Plan amendments at that time; discussed the amendments, and endorsed the recommended changes and recommended adoption of the Negative Declaration; and, WHEREAS, the City Council held a public hearing on the Negative Declaration, General Plan amendments and zone changes on November 6, 1995; and, WHEREAS, the Council considered all verbal and written testimony on the General Plan Amendments, Negative Declaration and zone changes. NOW, THEREFORE, BE IT RESOLVED that the City Council adopts the Negative Declaration and the following plan amendment and zone changes package: 1) 4144 and 4150 Redwood Highway General Plan Amendment from "Office" to "Retail/ Office" land use designation; and corresponding zone change from O (Office) to C/O (Commercial /Office) to provide a more appropriate land use designation, given the existing building uses; and te%j R I N A I aNQ 2) AP165-010-89 on the south side of Lucas Valley Road zone change from P/OS (Parks/Open Space) to (PD) Planned Development to correct a zoning map error and correspond with the existing "Hillside Resource Residential" land use designation. 3) 615 Lindaro Street General Plan Amendment from "High Density Residential' to "Light Industrial /Office" land use designation; and corresponding zone change from HR1 (High Density Residential) to LI/O (Light Industrial/Office to allow a proposed project. BE IT FURTHER RESOLVED, that the City Council finds these recommended revisions to be in the public interest in that they 1) (4144 and 4150 Redwood Highway) provide a more appropriate use designation for the properties consistent with existing uses, and provide some flexibility for limited additional uses without changes in environmental effects; 2) (Lucas Valley parcel) revise a zone district to be consistent with the existing General Plan; and provide the most appropriate zoning for this "Hillside Resource Residential' designated parcel in that the "Planned Development" zone district is intended for large residential parcels with hillside or other constraints to promote clustering on the least sensitive portions of the site; 3) (615 Lindaro Street) permit a land use designation compatible with surrounding properties without changes in environmental effects, recognizing the site is not suited for residential development and the proposed Downtown Plan amendments will offset a minor loss of housing potential on this site. BE IT FURTHER RESOLVED that the environmental assessment relied on the prior General Plan EIR to identify impacts of the existing land use designations, and identified no significant new environmental impacts resulting from new land use designations or zoning changes.
