HomeMy WebLinkAboutCC Resolution 9497 (Pop Warner Football Club)RESOLUTION NO. 9497 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute on behalf of the City of San Rafael a contract, lease or agreement with: POP WARNER FOOTBALL CLUB FOR STORAGE SPACE IN ALBERT PARK STADIUM (FROM 7/1/95. THROUGH - 6/3G/9-71 a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a REGULAR meeting of the City Council of said City, held on MONDAY, the 20th day of NOVEMBER , 1995, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Phillips JE M. LEONC I, CITY CLERK CITY OF SAN RAFAEL RENTAL AGREEMENT This agreement shall be between the City of San Rafael (City) and the San Rafael Pop Warner Football Club (Pop Warner) for the use of the locker room in the Albert Park Stadium Complex. A The City agrees to: 1. Allow Pop Warner to store football gear under the bleachers at Albert Park in the locker room at the end of the East Wing. BL Pop Warner agrees to: 1. Pay the City $70.00 per month for the use of storage space for the period July 1, 1995, to June 30, 1996 and $75. per month for the period July 1, 1996 to June 30, 1997. 2. Allow City to use the shower stall and lavatory portion of the locker room. 3. Keep and maintain in orderly fashion the locker room storage facility. Any storage use shall not deface, damage or alter the permanent locker rooms. C. It is further agreed: 1. The term of the Agreement shall be from July 1, 1995, to June 30, 1997. 2. That the Pop Warner will hold harmless, indemnify and defend the City of San Rafael and/or its officers, agents and employees from any loss, claim, liabilities, damages and/or injuries to persons and property caused by any negligent or intentional act or omission of Pop Warner, its officers, agents and employees arising during Pop Warner's use or occupancy of said areas and/or facilities during the terms of this agreement. The City of San Rafael and Pop Warner agrees to submit any claims arising under this agreement to binding arbitration pursuant to the covered provisions of the California Code of Civil Procedure and any successor statutes. 3. This Agreement may be amended or terminated by the mutual consent of the parties hereto and may be cancelled by either party upon sixty (60) days notice.
