RESOLUTION OF THE SAN RAFAEL CITY COUNCIL WAIVING
PAYMENT OF FEES FOR THE ST. ISABELLA'S SENIOR HOUSING PROJECT
WHEREAS, Policy H-20 of the Housing Element of the City of San Rafael
General Plan 2000 provides that fees shall be waived or reduced for projects
which provide more than fifteen percent of total units affordable to low
income (50-80% of median) and moderate income (80-100% of median)
households with at least eight percent for low income households for 40
years; and,
WHEREAS, the San Rafael City Council did on February 7, 1994, approve an
Environmental and Design Review Permit, Zone Change, Use Permit,
Subdivision, Trip Permit and General Plan Amendment for a 62 Unit
(including manager's unit) Affordable Senior Housing Project known as St.
Isabella's Senior Housing Project located at 1 Trinity Way; and,
WHEREAS, the St. Isabella's Senior Housing Project has entered into an
Agreement with the City of San Rafael to guarantee that the units remain
below -market -rate for 40 years, stating that 40% of the units shall be set aside
as below -market -rate units for households at a range of 30 to 60% of the
median income, and the remaining 60% of the units shall be set aside for
households at or below 80% of the median income..
NOW THEREFORE BE IT RESOLVED by the City Council of the City of San
Rafael that the requirement for payment of all Planning and Building Permit
application fees is hereby waived, except that the applicant shall be required to
pay all applicable Traffic Mitigation Fees; and
BE IT FURTHER RESOLVED that any application fees which have been paid
to date shall be refunded to the applicant.

foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the Twentieth day of November,
1995, by the following vote, to wit:
