HomeMy WebLinkAboutCC Resolution 9516 (Housing Elevators Amendment)RESOLUTION NO. 9516 RESOLUTION OF THE COUNCIL OF THE CITY OF SAN RAFAEL MAKING FINDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 17958.5 AND 17958.7 RELATIVE TO THE ADOPTION OF AN AMENDMENT TO TITLE 12 OF THE MUNICIPAL CODE OF THE CITY OF SAN RAFAEL BY AMENDING CHAPTER 12.12 "UNIFORM BUILDING CODE (1991 ED.) BY ADDING SECTION 5109 - "ELEVATOR REQUIREMENTS IN HOUSING FOR THE ELDERLY AND PERSONS WITH DISABILITIES." WHEREAS, the City of San Rafael has adopted an amendment to the Uniform Building Code (1991 ed.) by adding Section 5109- "Elevator Requirements in Housing for the Elderly and Persons with Disabilities"; and WHEREAS, the State Health and Safety Code Sections 17958.5 and 17958.7 require that findings be made in order to exceed the requirements found in the California Building Standards Code; and WHEREAS, the 1991 Uniform Building Code and the local amendments thereto made by the City of San Rafael include provisions that are more restrictive than the California Building Standards Code in that the provisions adopted by the City of San Rafael require the installation of elevators in housing for the elderly and persons with disabilities. NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of San Rafael does hereby adopt the following findings pursuant to and in compliance with Health and Safety Code Sections 17958.5 and 17958.7: CLIMATIC CONDITIONS: a) Heat experienced during the summer months would make the use of the ramps or stairs to reach residential units above the ground floor excessively difficult and potentially dangerous for the elderly and people with disabilities. b) Rainfall and damp weather during the winter months would make the use of ramps or stairs to reach residential units above the first floor excessively difficult and potentially dangerous for the elderly and people with disabilities. NOW, THEREFORE, BE IT FURTHER RESOLVED that the San Rafael City Council because of local climatic conditions that impact the ability of the elderly and people with disabilities to use stairs or ramps hereby adopts these findings pursuant to Health and Safety Code Sections 17958.5 and 17958.7.
