A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL MAKING FINDINGS PURSUANT TO HEALTH AND
SAFETY CODE SECTIONS 17958.5 AND 17958.7 RELATIVE TO
THE ADOPTION OF THE 1994 UNIFORM BUILDING CODE.
WHEREAS, the City of San Rafael has adopted the 1994 Uniform Building Code
with local amendments; and
WHEREAS, the City is required by State law to adopt the most current edition of
the Uniform Codes; and
WHEREAS, the adoption of the Uniform Codes is not a project as defined by the
California Environmental Quality Act; and
WHEREAS, the State Health and Safety Code Sections 17958.5 and 17958.7
require that findings be made in order to exceed the requirements found in the California
Building Standards Code; and
WHEREAS, the 1994 Uniform Building Code and the local amendments thereto
made by the City of San Rafael include provisions which were originally amended in the
1991 Uniform Building Code that are more restrictive than the California Building
Standards Code in that the provisions adopted by the City of San Rafael require greater
fire resistance for roofing materials and prohibit the use of wooden retaining walls to
support permanent structures.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council
hereby makes the following findings pursuant to and in compliance with Health and Safety
Code Sections 17958.5 and 17958.7:
I. CLIMATIC CONDITIONS:
a) Most of the annual rainfall in San Rafael occurs during the winter, and the
summer months bring on a pseudo drought condition every year. The lack
of summer rain combined with hot, windy days create conditions that could
dangerously spread fires.
b) Most of the annual rainfall in San Rafael occurs during the winter, and
because some portions of San Rafael are subject to tidal influences, there

are times that flooding conditions may restrict the Fire Department's ability
to respond to fires.
II. GEOLOGIC STANDARDS:
a) Because San Rafael lies near several earthquake faults, there are significant
potential hazards such as landslides, fires, and collapsed buildings which
hazards may be alleviated by stricter fire ratings for roof coverings and by
stronger retaining walls.
III. TOPOGRAPHIC STANDARDS:
a) Because much of San Rafael is located in hilly areas, there can be
conditions which may limit the ability of the Fire Department.
b) The rainfall in San Rafael has the potential of causing landslides in the hilly
terrain if proper retaining walls are not constructed under permanent
structures.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the San Rafael City
Council because of local climatic, geologic, and topographic conditions that impact the
frequency, spread, acceleration, intensity, and size of fires involving buildings and the
movement of earth in the community, and the potential damage to structures from
earthquakes hereby adopts these findings pursuant to Health and Safety Code Sections
17958.5 and 17958.7.

the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the 4"' day of December, 1995, by the
following vote, to wit:
